I seldom provide a link to the Murdoch press any more as most of their online rags demand you take out a pay subscription now.
If it is news it will be in the Age or the SMH, if it's just an opinion piece like this appears to be it won't be worth reading anyway. Personally I don't care if we keep posting links to The Australian etc or not.

not wrong guys. Im currently looking after my 85yr old mum with the start of dimentia. Im not hassling centrelink about UP yet as im flat out keeping my head together doing this and supporting my family in asia. Im seriously thinking of taking my mum over there, renting out the family home and renting a nice house overseas so we could all be together there. mum could have a carer, we all get to live in a nice house rather than our run down shack. Only thing is i would still be unedr the 6week rule and have to spend 6 mths in oz (?). other option is to bring wife and son here to oz, i stay on dsp at reduced rate (as im married), wife gets carers pension and we get child tax benefit. here we will cost the govt heaps more. Its a catch22 situation really. even taking mum o'seas still means I have to stay here for 6mths...

mate what makes it worse,i dont think the wife would get a cares pension for 2 years,and child either ,nothing from goverment 4 2 years ,you have to support them ,

Terry, I know of one case of a man forced to return to Australia because of very poor health. He was of age pension age so no problem there. The wife was placed on the carer's allowance apparently with no difficulty.............actually he was and is very sick so the case was straightforward. I know of one other case in addition to that. And its not six months that you have to be in Australia, but every six weeks, which makes living overseas impractical for a DSP. Check out the possibility of wife being your Mum"s carer in more detail. I would not rule that out.

thanks for the comments peter and terry. weve been married about 5yrs and ive been told she can apply straight away for assistance as weve been married for more than 3yrs. Also the boy will get tax benefit straight away. i dont like the prospect of having to live here in oz but may just have to due to the stupid 6week rule. and is it right that we have to spend 6mths a year in oz or we will be regarded as non-residents?

he is referring to the secret squirrel law that says in part," we recon that you been out long enough around about 6 month..."

Six months is not stated as the time abroad to be considered a non resident, but it will sort of become a rule of thumb for practical purposes.
It really only applies in practice to OAPs since no other group are now allowed out with benefits for longer than six weeks.
For OAPs at six months out they discontinue the rent allowance.............so that shows as far as the system is concerned, the system has decided that you have changed your place of residence.
The other catch is in the statement concerning the OAP that "if you are away longer than six months your rate of payment may be changed".
That translates as they will apply the 25 year AWLR rule to a person for full payment and on 1-1-14 it becomes a 35 year AWLR rule.
The Pension Supplement automatically reduces at six weeks out.
Residency no longer matters much. The six week rule sets the limit, and for OAP its the six month rule.
So everybody has now got new Rulers...............but at least the rules are simple.
For people with family responsibilities, Australia is the place to be as family benefits apply only here and not elsewhere.
For single OAPs, its a toss up, because once out it is for many a bridge burning, cause it will not be easy for cultural and financial reasons to return. And to keep a foot in both camps means keeping somewhere to return to, and if that is rent assisted accommodation, that means a return every six months, plus payments in your absence. Not cheap but worth considering.................more so if one needs to retain Medicare.
