I have just returned to Oz. I came back to re-establish my residency so that I can have the OAP portable in 2 years time when I turn 65.
CL has put me on Newstart but I am going to the doctors tomorrow and will try to get the ball rolling for me to get on the DSP.
I have heard numerous conflicting reports about leaving Aust for holidays during the next 2 years.
I have heard; No I can't leave at all. What ever time I leave will be added onto the 2 year waiting period. I can leave for 8 weeks a year, but no more than 6 weeks at a time.
Can anyone tell me what the CL restrictions are? I do not want to ask them at the moment because I told them I had come back to Aust. to stay here permanently.

I think if you leave during that two year period, the time outside of Australia will be tagged on at the end, so if you go to ? for three weeks that three weeks will be added onto your two years, also your payments will be stopped while you are overseas.

The DSP can be a bit more difficult to get on these days as well and there is certainly no portability to NewStart. I think with anything like re-establishing residency your best bet is the ask Centrelink what you can and can't do first, this gives you something to work off, if you disagree with their ruling then we can look at the situation then.

I'm in the same situation. Any further info on how they handle trips abroad during the two year period? BOth the replies above were not very conclusive.

If you leave the country during that 2 year period you're not paid. On return the pension is reinstated and the time you are away added to the 2 years.
Foe example: You stay in Australia for 12 months. You take a 3 month break over seas and return. You now still have to wait out another 12 months.
Unfortunately it's hard to be conclusive in matters that are not specifically covered under the Social Security Act but by "rules" made up by Centrelink.

Think I will be caught up in this 2 year portability rule (although I will argue/fight it). Does the 2 years start from the date of getting OAP or does it start from the date that you put in an application? If it starts from the date of getting a payment, is it permissible to submit the application incl all paperwork say 12 weeks prior to reaching 65yrs and then go back overseas for say 9 weeks and then get back a couple of weeks before 65th birthday?

You should give notice of intent to apply for the Age Pension 13 weeks before your 65th anyway. This is the time to ask them if they consider you a resident or not, if they say you are not then you can do what you like, it will make no difference.
