My intention was to visit Immigration when I return to Australia and find out from the horse mouth what the law is. As I wont be returning until late 2011 it would be good if someone on this board could do it on their next return to Australia and let us know the result.
It may help if you could get something in Writing from them.

I think it would be relatively unproductive. Centrelink's whole point is that if they consider someone a non-resident for their purposes it doesn't matter what anyone else thinks. We're dealing with arrogance and discrimination at a high level here.

We're dealing with arrogance and discrimination at a high level here. ..I know we all receive the obligatory letter after we return to our respective 'fox-holes' however, 'C' keep twisiting things as per my attached letter. <Para> 7 December 2010..>You have advised us you do not intend to return to Australia<..crap I told them on he phone my next intended date ie March 6, 2011. At least I have been given breathing/consideration space until March 8, when by that date the House will have resumed and the proposed legislation amendment decided perhaps! Has anyone been able to find the "Questions" put before the House for debate, to actually find the wording of the proposed amendments??

Basically the the bill amends the Social Security Act to require that a person must be an Australian resident to receive DSP. The Australian Government today introduced legislation to crack down on people on the Disability Support Pension (DSP) who live permanently overseas but return to Australia every 13 weeks in order to retain their pension.
The Families, Housing, Community Services and Indigenous Affairs and Other Legislation Amendment (Budget and Other Measures) Bill 2010 was introduced into Parliament today.
The legislation will close a loophole that has resulted in cases of DSP recipients living permanently overseas and flying back to Australia every 13 weeks to continue receiving the pension.
From January 2011, only DSP recipients permanently residing in Australia will be able to continue to receive the DSP except under limited and specific circumstances.
This change will bring DSP into line with other workforce age payments.

I found more info. about the current stage of the reading of the amendment bill having been passed by the House of Reps and now before the Senate in its 2nd reading stage with debate adjourned on 22/11/10. It appears to have been tabled and then adjourned without reading or debate. (I put a web-link for the info. of those DSPers interested). ROD. It was blocked by the Liberals Rod, something to do with income from trust accounts. It will be tabled again next year, probably with some adjustment to satisfy both parties. We reported and discussed this in the General forum at the time if you want to have a hunt for it.

These are Centrelinks current residency forms. Going through some papers today and came across this form which I had to fill in last year. Seems to be custom made for individuals. 1. Please provide a detailed statement of how you fund your travel requirements to Thailand.
2. Please provide a detailed statement of your place of accommodation in Thailand.
3. Please provide a detailed statement of what ties you have to Thailand.
4. Are you a member of a couple?
5. Do you have an overseas bank account or own property in Thailand?
6. Please provide a detailed statement on what ties you have to Australia.
7. Please provide a detailed statement on how you support yourself whilst staying in Thailand.
8. Do you do paid work while staying in Thailand?
9. Are you involved in self employment or operating a business while staying in Thailand?
I declare that to the best of my knowledge my answers to the above questions are true and correct. I understand there are penalties for deliberately giving false or misleading information.
