If you have stayed a resident, and you would know if you weren't, then you can claim the OAP and leave the country straight after it is granted. You are only going to be really sure when you ask Centrelink though. Better to do that now than have to worry about it at the last minute. If you are a non-resident you must live in Australia for 2 years AFTER claiming the OAP.

it seems the trick is to make sure you retain residency, so if i increase my time in aust for the next 2 years and maybe live there for a few months before claiming the oap, i should get it with full portability ? I'm a cleanskin with centre link never been on anything, dole pension, nothing, no govt handouts always worked etc, my passport will show i'm in and out of country often, but compared to renting a place there full time a few extra flights would be cheap. as i already have bank accounts there, no problem there, how would i know if i didnt have residency before i claimed?

Sorry, I thought you were on the DSP which made me assume residency. The sure way is to ring Centrelink now and ask them. We can't offer professional advice here, only offer the benefit of personal experience. If you hadn't been back to Australia for years you may have a problem but you have returned regularly so you should be OK. Centrelink may consider you fall into a "grey" area, they have lots of "grey" areas, which is why you should find out now. I don't know what the OAP application forms look like or what they ask about residency, pick some up and have a look. Once again.... ring Welfare Rights and see what they say.

Just a word of warning about phoning CL . . . particularly if you want an advantage over them in gaining info rather than them taking your info. I know when I contact the call centre for CL International I have two options. The first is to respond to the Call Centre agent's request for my CRN and details . . . and this can now of course be done automatically via voice recognition, etc. Once you have done this the Agent's daily quota gets and tick, and anything you say can be used against you, and you will get a receipt number offered for the call. IF YOU ARE FISHING FOR LOOPHOLES DO NOT DO THIS. Just phone and as soon as they start their fish-hook spiel, inform the Agent this is just a general policy query. Then you are the fisherman and you are not looking over your shoulder. BECAUSE ONCE THEY LOG WHICH CLIENT YOU ARE THEY CAN TYPE ANYTHING UP ON YOUR WALL. Like, say, this clown phoned to ask if he should tell us about his 4 Asian bank accounts!

My little trick is when someone ask a question like eg: " What did you do last night?" my reply is always a question "WHY" this usually stops nosy people in their tracks its worked for me for many years.

Mama isn't on Centrelink benefits so that shouldn't apply anyway.
I may till be a bit of an idealist but I hope that the average Centrelink officer on answering the phone duty wouldn't make up lies about a caller, even if someone was red flagged as a pain in the arse I would suspect that would make them even more careful about dotting the i's and crossing the t's correctly.
We tend to forget that we are dealing with public servants here, they would be fully aware that appeals against decisions can end up in higher courts where the penalty for perjury could be quite severe.
I prefer to believe most of them prefer to do their job as hassle free as possible while watching the clock for happy hour.
Edit: Banker has it spot on, answering an unwelcome or intrusive question with another question is definitely the way to go.

Back on topic for mama, when you go & ask C/L about you situation re residency, please please get it in writing stamped & signed by the C/L officer. Also if you lodge any documents into C/L always keep a copy for yourself and get C/L to stamp & sign that also, they seem to be getting into the habit of loosing documents etc. I believe they are doing this just to give people the run around in the hope you will just give up and go away. Centrelink staff have a massive work load these day with all the new rules coming in and their massive staff cuts etc.
