PLEASE HELP - I am at my second AAT appeal (today 2.6.17) . I presented my medical certificate yesterday at Centrelink and it was refused. CAN THEY DO THIS? It is based on both my condition being discussed under my application as well as a newly diagnosed Complex PTSD. I am now expected to attend job search provider and will be forced to disclose issues relating to barriers to work. My CPTSD is a result of extreme childhood sexual abuse over years as a small child and have spent the night on the floor vomiting and in severe spasms of anxiety about having to speak to strangers about any of this. PLEASE PLEASE what can I do short of never waking up again.

My advice would be to attend the 2nd Appeal and see what the outcome is seekinggrace. My understanding is that even without Clink accepting your medical certificate you will still be exempt (I am in the same situation) and sometimes having a DES provider on board can help as well... If you need help after todays appeal i am happy to share my experience - although my conditions are different I am in the same situation.

CAN THEY DO THIS? NO THEY CANNOT. But they still do with no one to answer to. Present it at the AAT also and tell all. GGGRRROOOWLing again. Hopefully good news on the result tomorrow morning.

None of us know what your background is or past treatment, so it's a bit hard to give accurate advise.
But if you feel that you are too unwell to face the AAT today, then maybe head straight to the hospital emergency, or the medical clinic that you have been using.
Tell them what has happened, how you are feeling, ask for a social worker to contact AAT to postpone your hearing, and then work through the process with the help of the social worker.
Then later on, phone your local member and the Commonwealth Ombudsman to complain about your treatment from Centrelink.

Thank you for replying everyone - my AAT has now progressed to court - I am so very lost - I have met ALL their criteria and I keep being denied and expected to provide more and more.Now the indignity of having to bare my soul to strangers in some job provider network. Social worker at Centrelink vomits up dept policy and gives me welfare rights numbers to ring. WTF. They have granted me a carer as I have difficulty showering - cannot ambulate around supermarkets - do housework and sometimes even dress myself BUT I CAN LOOK FOR A JOB and dont qualify for a DSP.

Hi SeekingGrace, When I mentioned a social worker in the above post, I was thinking of one the hospital could contact.
I have also been rebuffed by a centrelink social worker on the phone, and it felt as if she was attacking me, and would never contact one again.
But I think you need someone like a social worker or advocate to help you sort it out.
As I said above, turn it around and start attacking them. Complain to your local member and the Ombudsman first, and contact Rachel Siewert, the Greens Senator.

Hi tasjo I would be really grateful to chat about your experiences if that's ok My AAT Appeal is about to have its 2nd Case Conference. A few things that I feel have helped... 1. Contact Disability Advocacy - particularly as you are dealing with a mental health impairment. Have them attend appointments with your DES Provider and your AAT Appeal. 2. Check that your condition was diagnosed by either a Clinical Psychologist or a Psychiatrist... if not, you will not be considered 'appropriately diagnosed' and will receive no points. 3. Look at the symptoms of your condition and consider whethet they give you impairment points on any other Table... for instance, what are the reasons you have a carer - does it include fatigue or chronic pain? 4. Dont 'write off' your DES Provider before you see them... mine has been very supportive this time round because people they cannot 'help' make them look 'bad' as well. 5. If you feel you wont be able to cope with a court hearing get things in order and reapply. It wont give you back payment but can be done in addition to the AAT Appeal. I am in the same position as you, my husband receives carers payment for me due to my disabilities, but all I have been told is that there are different criteria... he is restricted in his capacity to work because he needs to care for me but according to CLink I can work more than him... hmmm I also have permanent incapacity from work and have been approved for Total and Permanent Disability from my Super (again, Clink says that doesnt show an 'ongoing incapacity to work') Lastly, dont assume that the AAT has all the relevant documents, they didnt have a lot of mine and so their solicitor required additional documentation even though his 'client' (Clink) already had it. I am happy to discuss on the forum as long as its not personal details.
