The Unlimited Portability currently does not appear to threaten residency status. The grandfathering of the DSP always appeared to me to be a way of paying non-residents the pension. I'm still dubious whether a returning grandfathered OAP would have to remain in Australia for 2 years before leaving again if he requested residency. It would certainly make an interesting appeal.

As I have discussed with you on several occasions, If I return to the Lucky Country and try to get my residency back I must first prove that I intend to stay in Australia eg, lease on property, phone & elect connected, bank account etc etc, and I must remain in Australia (the prison farm) for two 2 Years. This is what I have been told by C/L several times. (We all know that C/L make up their own rules) IMO: This would not stand up in a court of law, Im sure if one was to fight it they (Pensioner) would win.

The Unlimited Portability currently does not appear to threaten residency status. Its not the U.P. that threatens your residency, its your time outside of Australia and the close ties you keep with Australia.

The irony, the country that was built on the immigrants back and people with an adventurous spirit who were willing to travel large distances and build and be part of new communities in Australia. Only to find they now have numerous obstacals put in their way, should they wish to travel and look for adventure in their old age.

The two hiccups I see in Immia's CL notice are: The verb "may" confirms that say, a Murdoch Senate in Oz CAN reduce everyone's base pension rate. Two, the residency requirements still could cause problems unless you visit every 6 months or so, and keep something ticking over onshore. But it seems to undermine Banjo's conviction that UP means constant residency regardless. U.P. does not guarantee your residency status. I have U.P. but I am told by C/L that Im not a resident. But it seems they don't have the power yet to make you a non-citizen I hope Boss; but that's comforting news about your "UP" and non-resident status for other OAP's I'm sure:) Be safe Banker Boss...
