Good link Fed Up. - Guide to SS law, residency. An interesting paragraph there for former residents who were granted their pensions before Sept 2000. Only get a 12 month wait in Australia penalty. But they don't elaborate on what pension issued before 2000. Seeing as they are talking about returning to claim the OAP. Also note the last paragraph. Does that mean they won't give you the OAP if you evan say you might leave Australia after the 2 year waiting penalty.

Keep in mind that "The Guide To Social Security Law" is exactly that, Centrelink's guide to it, or what they consider it means. If the appeal goes past the AAT, the Federal Court only considers the legislation.

Because of the 2 year residency threshold I don't figure to ever be on the OAP but will just continue with DSP.

Woke up this morning to a email telling me to contact centre link, I rang the Thai toll free number and eventually found out immigration had flagged me , it was about residency. They said I had spent 6 mth in Australia in the last 2 years, true , and the questions started. After my phone interview the guy on the other end of the phone said no Problems, he expects me to be out of the country a lot for at least the next few years as I have a newborn in Thailand and closed the case. He said that I can expect this sort of thing to happen from time to time given my amount of time I will be out of Australia and wished me the best. Was I just lucky or have I been scammed? ........hope that's the end of that for a couple of years..............why did they only look at the last couple of years? Is it because that's when legislation changed?

will, you still on DSP? i would not wonder if they cut you off soon.
minimum stay should be a little more than 6month per year in australia and all your travels should be not to the same place plus maintain residence in australia( home rent or own,utility , internet and telephone, car, bank account, PO boxes,etc..}

Is it because that's when legislation changed? Will are you absolutely positive that you were not dreaming it? Thats all i can think of to explain the actions of your c/link rep. The other very remote possibility is you connected with some one that actually had feelings and was sympathetic to your situation, again remote, but a one in a million chance so looks like you hit the Jackpot. I got exactly the same call and was immediately marched back to OZ to explain.

I think you need to be careful Will, personally I'd hang about in Australia for a couple of months before your next trip.
I see you have been on the DSP for quite a few years, are you getting close to the Age pension? If so you need to be extra careful with your residency.
Unless they have changed a lot in the last year I cannot see them being sympathetic because you have a child overseas.
I'll send you the UP password, it needs changing but if I do it next week I'll send you the new one as well.

Well it's September now, still have not spent more than 1 wk every 6 or 7 in Australia and have been left alone after that last residency check. But I know it's all over next year. 4wks then no pension after 27 yrs

I’ll be giving my MPRE exams this year and have registered in an online prep course that provides many resourceful MPRE Practice Questions.
