Legal aid lawyers are either new to the field or can't get a job. If a lawyer is an expert at any type of law they will not work for legal aid.

Sorry imm but the first legal person i spoke to was legal aid and she told me in 5 minutes things that eventually got me UP. C/L denied what she told me was true but it turned out to be spot on. She was an expert in C/L law i can guarantee it. Anyhow he has no other choice at this stage.

There was one in Adelaide I went to a while back (before DSPoverseas) who was well on in years, I suspected she was retired and doing a bit of volly work to fill in the week. Agree she wasn't much good though.
There was one I spoke to at a community center who said he worked for a big firm. He never knew much about portability though but he did show interest and asked me to let him know how I got on.
When I did my residency appeal in 2011 Legal Aid refused me assistance.

In the course of my UP appeal, I was directed to a legal aid lawyer who spoke to clients referred by AAT. He was very helpful and if it were not for him, I would have continued up the wrong road and probably failed. I re assessed my direction, followed his advice, prepared more relevant information and won in the end. So probably like all 'professions' there are good and bad. In today's world the fact that a lawyer does not have a job, may not reflect their ability, but rather the state of the nation in general?

It's a bit of a knee jerk reaction to assume that someone who chooses to work for a lower salary to provide a free service is subsequently less competent than one who gets mega-dollars at a major law firm.
The point could be made that one of the big names would rarely see a welfare case while a legal aid lawyer would handle them on a daily basis, surely experience would count for something there.

The Administrative Review Officer (ARO) is not really an appeal, you just ask some Centrelink seatwarmer to rubberstamp the decision they have already made. Probably right with new claims, but i had my pension cancelled and many months later overturned by an Authorised Review Officer (ARO). She simply called me and said she had the power to overturn the decision. I certainly did some fast talking. They had to back pay me.

I may have been a tad harsh, I got half a decision off one on a very complex case once, he overruled an order that I pay back about $30K (about half what I owed them) and said the investigating officer had acted improperly in some areas but still didn't reinstate my pension. Made my SSAT a piece of cake. Glory days.
