Well here you all go, Get a phone call Friday from program litigation and review. The man on the phone asks if its ok to talk I say fine. He goes on to say he has reviewed my case, and himself and the powers that be have decided to grant my DSP and back pay if I sign an agreement. So I get home and there is a express envelope with a letter saying that I met a program of support or was exempt and my entitlements. I can't believe it, then I started thinking it doesn't say anything about 20 points in one table and that's what I been fighting for. Sure ok for now but what if I want U/P? I think this is a trap, as it says if I don't except this offer it is void if it goes to AAT, and can't be used. I am going to get some legal advice, let you all know what the sinister bastards are up to

You obviously have a watertight case and they know that. I was in a similar position some months ago, and went through the same process that you are going through. As I write this note I'm well ensconced in the Philippines drinking a Litro bottle of Red Horse and happy as a pig in shit. By all means get legal advice, but remember it cuts both ways if they sign they are also bound by the terms of the agreement, so what have you got to lose, look at the win loss ratio when it gets to the AAT. Best of luck Itsa

Itsmylife08 did you have 20 points in one table? Banjo I will get the letter back off my solicitor tomorrow and scan it. She is writing another clause in it after I explained my concerns of U/P. It will just be 1 line saying that I meet the 20 points in table 5 as my doctor has stated. Her thinking is that it will bring out what is really going on. If they will not allow it, then sure I get DSP but can't leave Australia. That makes sense as they want us all here. Will be in touch everyone

Thanks Jimmy.
Curious about why they think that you would refuse the offer. You may like to to consider asking for the assessing report and if they refuse use the Freedom of Information Act.

Will be in touch everyone Hi Jimmy yes I originally had 20pts when first granted DSP which was granted after an appeal. I then applied for UP which was rejected. The JCA took away 10pts from Table 4 Spinal disorders. Jimmy look carefully at the wording in table 4, you only have to meet one of the criteria to qualify, the key word being (or) this was confirmed to me in an AAT conference. I honestly believe that there is nothing sinister about the offer, they are just trying to cut costs , plus prevent any precedence's being set at a hearing. As I said by all means get legal advice , I had the luxury of knowing that I'd still have DSP even if I lost . All the best Itsa pm me if you wish

Thanks everyone.... Just got off the phone from centre link legal review. I told them my legal people said they want to add a clause C to the settlement. He asked what and I said that the agreement never states that I have 20 points in one table namely table 5 and that I have been fighting for this mainly all along. I went on to say that my 2 reports from doctors both say I fall into 20 points. To my surprise he says that should be fine because your DSP was granted on 20 points in table 5. Rang my solicitor up and she will have the letter done today by 5.00. It would appear they have truly given up full stop. I cant stop thinking about the turn around, maybe someone up top has said stop wasting SSAT and AAT time? After 2 attempts and almost 2 years it feels to be not real, sublime in fact !!!

anthonydsp, Yes I am going for U/P next. I think I should strike while the iron is hot so to speak. I don't think I can lose much, as I have them on paper. I wouldn't think they would dare try and cancel me. I will let everyone know how it works out. Cheers
