Guys, I appreciate the input, but I still can't figure out what 'portability' of the Aged Pension means. None of the above is at all helpful. Age 65 or older. You are living in Australia, receiving the Age Pension. You are an Aussie Citizen or Permanent Resident. You have not been asked to renew your residency by staying in Australian 24 months. You have 35 years of Working Life in Australia. You may leave at any time and you do not have to return. If like me you don't have 35 years of Working Life in Australia, you will lose a percentage of the pension. I cannot understand why Australian Pensioners who live outside Australia are not asked for their opinion of what is happening. Not employed by Australian Department of Foreign Affairs and Trade I guess!

So Far Alanna MacTiernan as sent me an email back saying she is getting advise on this. Mr Gray also responded.The other 2 have not as yet responded.I will keep you up to date as to any answers I get. Yesterday I spoke to Ken Wyatt secretary and she was told that in my circumstances the portability rule wont apply.Its just for new immigrants . I now wait for a written response from him to this question..We will see.. I have not heard from any of the politicians I have contacted..just keeping you informed.

Both the DSP and the aged pension have a residence requirement of 10 years to qualify which far exceeds the returned resident time of two years to qualify for portability. Once again a politician that doesn't know what they are talking about.

Hi Immiadvice, So the 10 years is the time you have been out of Australia..Thats what portability is about you think. The 2 year rule would be rubbish. I am still confused..

Don't be confused. It's simple. The law is targeting those that Centrelink deem as returned residents. That is, someone that has recently returned to Australia after living abroad.
If you fall into this category you will have to remain a resident for two years before your payment is portable. If you disagree with being a "returned resident" then by all means appeal the decision but I would assume your immigration history may make that decision easy.
There is nothing confusing about it.

Where I think that a good appeal could be made is that there is nothing in the legislation stating how long you have to be overseas over what period of time before you lose portability.
Sound familiar?
I think giving it to anyone entitled to full AWLR would be a good start, regardless of whether they did spend a few years out of the country before reaching the Age qualifying level.
I would have been out of Australia for at least 8 of the 10 years prior to turning 65 but because I was already on a residency based payment there was nothing they could do.

I posted the letter about Portability on this face book group..(Australian pensioners & welfare Group ) All I got back from the moderator was where is the proof. Then a couple of rants about stopping the pension being paid overseas. I was shocked.

Then a couple of rants about stopping the pension being paid overseas. I was shocked. I'm the only administrator of the FaceBook page and it wasn't me. I'll take a look and delete anything offensive. The trouble with FaceBook pages are they have to be watched all the time, there is a moderators job there if anyone wants it.

Sure, I have a personal page but rarely use it now. The Auspensioner Dspoverseas page is a useful tool that has helped put our message out that help and support is available for people being unfairly treated.
I have to look at these things as tools, useful if you know how to use them. Treat them as toys and you'll be playing with them all day.

dave3478, back to your post not heard from politicians. In 2008 i emailed every labour politician and others from the libs also. Not a single reply. I then visited around a dozen of them from both sides and spoke at length to many of them. All to my face said they wouyld investigate and get back to me. They all seemed genuine in their concern for my injustice. NOT ONE EVER CONTACTED ME AGAIN. So i would expect you to get zero replies also as all politicians have no other interest in anything other than their own pay packets. Bolt etc likewise. But in saying that i encourage you to keep at them just in case there is one decent one among them.
