thanx for that i will do what i have to do here 1st an then test the waters an see what is said.i have prob ably spent at least 3 to4 months in aust out of the past 12.also what does IMO mean?

to banker, i was also told if i leave now my dsp will b stopped.i will ring them an let them know that i plan to travel o/s at the begining of march an see what they have to say? in my interveiw i was told that my travel habits are"not to bad"compared to other people.i have probably spent 8 of the last 12 months in aust.they also wanted to know what ties i had to o/s like lease agrre on house ect.which i replied i have no ties.also i was wondering if i ring c/link inter that when i enter my C R N that it will send up a red flag an connect with the person that interveiwed me on the 1st of feb when i returned.i was told that they have 4 officers looking after this new ruling.

Mate, as Banjo said contact welfare Rights about this because you DO have rights & IMO they can not stop your pension unless you break one of their rules, only spending 4 out of the past 12 months overseas is not breaking any rules or law once again IMO. You must never have any ties to another country except Australia, always state that you are just a tourist. As I lost my residency back in 2002, I'm not up with a lot of current changes because they don't involve me, I can come & go into Australia as I please, as I'm grandfathered into the old system. Perhaps some of our other members might like to give their opinion on your situation.

to banjo i had aphone interveiw an was told that" i might let you go for a month in 2 months time" an ask me to get a letter from my landlord(i rent a room) that he is happy for me to stay there for the next year? proof of residency is all important in this debate!! This has to be challenged. Next they'll be telling uninjured Australians they are not allowed to holiday overseas.

Banker when did this grandfathered thing start of.? If you were on DSP in 98 and 99 but then went off it but never returned to the workforce and resumed back on the DSP in the last couple of years would you be entitled to be grandfathered?

The grandfathering happened twice in the last decade.... 2002 and 2006??, You had to get it right then on the spot, I've no idea how it was handed out or why some got it and not others. I missed out on both occasions.

I got my DSP in 1995?
I started to travel overseas in 2000. At that time anyone on DSP had to return to Australia every 12 months, then in 2002, C/L started calling everyone in for re-assessment, some people were told then they had to return every 6 months?
When I went for my interview the officer told me according to my medical records that I was classed as being severely disabled and I could stay out of Australia for as long as I wished.
In my file it says that I was Severely Disabled and Grandfathered. I got my file under the FOI last year. I think everyone should get a copy of their file you may get a surprise at some of the lies the staff put on your file.

Because of my ties to Australia it suits me to return regularly and spend a lot of time there.
What you said about interviews surprises me because I know people who were never asked to return to Australia, they were just told they were "severely disabled".

I was interviewed at the Beenleigh C/L office in Q'Land.

i started on dsp in early 2004,febuary i think? so how do i know what i am classified at or how do i find out my rating?

It will be in your file somewhere. We will all have to do a reassessment anyway.
