At a BRIEF GLANCE AT IT i DID NOT SEE THE TERM aCT OF GRACE under WHICH i PUT IN A CLAIM MANY YEARS AGO AND IT WAS REJECTED BASED ON TOTAL LIES BUT UNDER THIS SYSTEM THERE IS NO APPEAL AVENUE WHATSOEVER. WELFARE RIGHTS TOLD ME WITH THE DECISION it IS PURELY BASED ON WHAT SIDE OF BED THEY GET OUT OF AND IN ALL CASES IT IS LESS THAN 5% SUCCESSFUL. sO i HOPE THE LINK IS DIFFERENT.

I suspect if you were denied DSP for years and then were vindicated by finally getting it that could possibly be one reason. But i think lawyers would most likely need to be involved to win in the finish.

I just had another look and saw act of grace and i was covered 100% by this but was still rejected with lies and no right of appeal as i said. I think this system in itself would be illegal because it is not based on facts at all. But give it a try by all means if you think it is right for you as you may be in the 5% or less who win a prize in lotto.

I am sorry if I seem ignorant, but I do not believe I have heard about this issue. Could you tell me where I can find some information on what happened to Rue from Wagga?

I actually had someone from the 2010 Minister's office ring me up. After some pleasant discussion which basically amounted to 'no chance buddy' the person asked me if I wanted this correspondence and phone conversation deleted or recorded on my file! I said kindly record it. It later intrigued me that C/Link had my history dating back to pre computer type times.

I also made a claim under CDDA that was also rejected in 5 minutes. Did the legislation changing portability from a year to 3 months have the intention of making people travel from North Thailand or elsewhere to anywhere in Australia every 3 months for no other purpose than to pass through immigration before boarding the next flight back. No need to even leave the airport. The logic defied belief but my claim was rejected on no logical or lawful basis at all exactly the same as act of grace was. I am still hopeful of compensation one day though as I believe many others are entitled to also. As i said though, it would bankrupt the country if all were paid up that deserve it.

I did wonder about attempting to claim compensation when Clinks solicitor at my 1st and 2nd case conference admitted that AAT1 had misinterpreted the impairment table and should have granted 20 points on 1 table. However, as my DSP was granted prior to the AAT 2 hearing I wonder if it would have any legs...

This may seem like a stupid question but I will ask anyhow.
If one was to receive compensation from centrelink while on centrelink payments, wouldn't they loose fortnightly payments until centrelink deemed that all the money had been used up for supporting yourself?
I was of the understanding that if you receive a compensation payout for anything while on any sort of benefit, you have to declare the compensation and then centrelink would work out how much of your benefit you loose or keep?
Is there different criteria for centrelink compensation payouts and compensation payouts from other places?

I would have thought that if the claim fails, then is awarded on appeal then if the payments are back dated to the original lodging of the claim a further claim for compensation would be difficult. You would need to be looking at pain and suffering caused, notoriously difficult to put a price on without a complex court proceeding.

One is 'income' and the other is 'capital'. You really need to check a solicitor/lawyer. But 'income', vast majority of cases will affect your DSP. 'Capital' insurance pay outs are a different kettle of fish.

I have never personally had anything to do with compensation claims of any sort as there has never been a need. Maybe I have lived a sheltered life or just been lucky, who would know? lol.
I had for some reason formed the belief that all compensation payments were something that would affect your centrelink payments. I think I have come to this conclusion from reading that you must tell clink if you are getting compensation or are likely to.
Thank you for the information Dennis, makes everything a little clearer for me.

I can't remember the name of the thread or find it's location bfbf! It's a real horror story, waiting six years for DSP. It is published in "The Daily Advertiser." from Wagga, and a suggestion in the thread for members to contact them, offering our support to her and telling them Short Stories of Any ongoing sagas of our own. Whoever posted either one of them would you please point bfbf in the right direction if you could? Cheers, thanx in advance; bear p.s. Unsure if anyone took up the suggestion to contact them or not!
