I did hear somewhere you could continue to be paid the DSP rate while you were appealing an unfavorable decision, I am not sure if this still applies if you have already had your DSP cancelled and have gone onto Newstart.
My feeling is you should appeal rather than reapply. Firstly you need to get your entire Centrelink file through FOI and find out exactly what they are saying about you. Your most recent Job Capacity Assessment which you did for portability is the best gauge of that.
One other point, there are many good people working in Centrelink, particularly in the Medical Assessments department. Remember they are Health Care professionals and have insight into how tough it is for people in your situation. They know people become institutionalized after being on the DSP for 20 years and have very very limited job prospects.

Yes, you can re-apply while there is an appeal ongoing.
To summarise the advice given.
1) Appeal the decision 2) FOI request about the decision AND any medical information relating to your impairment (it's quite possible they cancelled your DSP because the medical information they have is dated) 3) Talk to your Community Legal Centre about the decision and what information (and from whom) you might need to re-apply 4) Make yourself aware of the Impairment tables 5) Get you medical information together to support the Impairment table/s criteria 6) Re-apply (You can start the application anytime as , last time I checked, it's 34 pages long and only 1 page on "medical information".

Ok...thanks everyone for the reply....was in centrestink all morning and as it happens the answer is..."if yr still on dsp then you cant re apply"...obviousely. And the good news..."they cant cut you off if you have lodged an appeal". Seems like my fall down may have been my work capacity form saying"must be completed by a person with a disability"...thinking I should fill it out myself but actually it should be filled out by a doctor...So I may lodge my appeal tomorrow with a letter from my GP.Because apparently then it gets reveiwed in three weeks time and if I cant get a psychiatrist to write a medical reveiw and this time a work capacity assesment before then...I am allowed to send it in later...so im hopefull to get re instated but wont be going oversease anytime soon😓
Hi Krez, did they say you no longer qualify for the DSP under the new medical tables of 2012? did they give any reasons why you no longer qualify? anyway good luck with your appeal, l'm glad your still getting the DSP rate
Ok...Krez here...I just received the news that my U.P application has now been granted after being cut off and appealing....For the appeal I was lucky enough to get a psyche appointment so she could write a letter and also a letter from my GP...short cover note...all within the 3 week reveiw period.The fault of centrelink was that the medical reveiw was done by a physiotherapist and that they just needed more information...but they were very helpful and friendly during the whole process and im really happy that im now free...thanks for all your support..bon voyage..first stop Bali😆
