Welcome to the board nomadic. Your story sounds very interesting, if you could send me a link I'd be obliged, we need all the experiences we can get.

Basically, like many of us you missed out on the lottery of grandfathering. I wish you luck with the case if you take it further but my inquiries have shown that the government will NOT grandfather any more pensioners on portability issues.

thats interesting, the last conversation with centrelink , the polite lady i spoke to said that I would be having my residency asesed for a number of reasons time away no car no physicall possessions etc etc. she said some one will be calling me regarding the above. So I decided to fly out from kuala lumpor on Sunday and had a lease ready to go in tweed heads.
and then I get a letter that says
" if you return to Australia by 6th march, no changes will be made to your pension. If you don't, the pension will be reassessed."
I guess thats a good thing since its in black n white, any thoughts anyone?

It's certainly thought provoking, they are giving you a chance to keep your residency if you follow their advice. Is 6 March your agreed return date anyway? It offers no assurances on future travel, unless you want to push the envelope I'd suggest you stay in Australia for a while.

hi Banjo yes returned date was 6th of march. I will be applying for permanent portability when I get back because the way I see it they have confirmed my residancy so nothing should stop me
I will be in Oz for at least 4-6months I would say
I think with me they jumped the gun with the residency question and she sent it off like she said she would but head office have looked and seen Im only awol 18 months ( less than the 2 year rule of thumb) so they had no choice but to give me my residency
But of course I could be totally wrong about everything ;D
edit. does anyone know the process involved for a cash advance from c/link for an apartment lease?

I don't know if you can get a special advance for an apartment lease. But you can get an advance of just over $1000 either in person or online. Just be careful that you say you have $80 per fortnight to spare, because that's what will be subtracted from your payment if you opt for the $1000. It takes 6 months to pay back.

I was wondering how one could afford an accommodation lease in Tweed Head which has the advantage of being near the Gold Coast airport, now I see above that it is not so easy.
In Cairns we still have a few studio places around at $150 a week, but the difficulty is the airport exit from here.
The only cheap way out being Darwin or GoldCoast airport.
From Cairns to Darwin is twice the price of Cairns to Gold Coast, but living on the Gold Coast if one can find an affordable roof, saves the hassle.

thanks LD same same but different. Yes being close to GC is an advantange and would save a bit on travell.
There seems to be no shortage of $150 apartments around tweed heads, but mostly bedsit and 2 are complete beach frontage at $180
I just recieved a fax of my letter its 2 pages and it even says that I can travel every 6 weeks as long as they have notice before I go.
Its a claytons letter that just reafirms my residancy.

If you return from OS how long should one stay in Oz before heading back? It seems if you leave right away residency alarm bells start going off..

You may just have got that bit right.
It's a how long is a piece of string question, the only way to find out is for someone to get busted and appeal it. Personally I think ties to Australia and lack of overseas ties will over rule time spent away.

Yeah and if your not spending anytime in Oz that's a big bit of evidence right there..even if your renting somewhere. Maybe car rego helps.. Banjo it seems we all need a bit of luck!

I got sick & tired of all of C/L shit, lies, lack of knowledge, poor me overworked & underpaid & appeals crap, so I decided after lots of research (that I'm more than happy to share) to go outside Australia, go higher than our government & go to the highest place I can complain to & get a reply in 7 days..... The United Nations. Bugger c/l appeals crap that takes forever...bugger waiting for appeals b4 going to the ombudsman etc etc I don't suffer fools & am on DSP legitimately.... I would get treated better if I was a refugee & I have the figures & information to prove it. I like many others cost the tax payer (& for many years like others was one) less when i stay o/s & treatment that many specialists in OZ have said I need, I can't afford in OZ but can o/s. Under the UN I am still a resident & citizen in OZ UNTIL I LEGALLY GIVE THAT UP WITH PAPER WORK ETC & i HAVE TO BECOME A RESIDENT OR CITIZEN IN ANOTHER COUNTRY BECAUSE I CANNOT LIVE ANYWHERE IF I AM NOT A CITIZEN & RESIDENT OF ANOTHER COUNTRY & I CAN STAY IN MANY OTHER COUNTRIES FOR 100 YEARS AS LONG AS I FULFILL THEIR VISA REQUIREMENTS !!!!!!!!!

Hi Melnee, The word "resident" has a double meaning. As you say, they can not take away your Australian residency (or citizenship). But they can say that you are no longer resident (that is to say, LIVING) in Oz. Various government agencies define residency differently. The Australian Tax Office and Centrelink both have different definitions and rules for determining whether you are resident (or living) in Oz. Also you have to listen very carefully to catch whether they are talking about being "resident IN Australia" (ie currently living here), and "A resident OF Australia" (which I suppose means whether you are legally a citizen, with voting rights).
What I find outrageous is the fact that the government takes away your Medicare entitlement if you're overseas too long. And if you're about to claim the old age pension, even if you've worked in Oz for many years......if you are overseas too long, when you return they make you stay in Oz for 2 years before they'll pay you the pension when you go overseas again. This was originally intended to stop migrants from coming to Oz, working a few years, then taking off overseas and being paid an Oz old age pension for the rest of their lives in Greece (or wherever), but the government has not changed it.

This is an interesting question, my MP's assistant told me that the portability changes were justified as it kept them in line "with other countries". If I ever get a few days to spare I'll google search it.

My bro has just done all the research in Nz about portability and if reckons that if he stays out for 26 weeks he loses 2/3rds of his pension he is adamant they apply it as absent for more than 26 weeks in ANY one year and you get cut
