hi guys.i am alex.been on DSP(class as SEVERE) since 2001. sold up evereything in april 2004 and went to my motherland(no social security agreement with australia)told centrelink that i'm leaving.some1 from tasmania contacted me to tell me that i'll be recieving my DSP indefinetely if i leave b4 june 2004 and law will change after that day.anyway i left before that day.but had to came back after 2 months.(due to a big family dispute.basicly i run away back from the problems,dealing with them instead) now im facing bigger problem sent my wife and 2 kids to overseas to see her sick parents(both 72yo) but she doesnt wanna come back because doesnt wanna leave her family,and maybe this is the last time she'll spend time with them.im stuck here by myself and no security in overseas.and here we tired of going without of most of basic things.my only security is my DSP. but centrelink says i can recieve my dsp only for 13 weeks in overseas.im 40 yrs old and i was working(which means i was doing my part as a GOOD citizen.paying my TAX) when i had my car accident.6 years in hospitals,7 operations.depressions,physios and this is what we get back?even if i can afford i still want leave.because system makes me sick and its rubbish. thank god finally i pour my heart out to people in same stuation like me.

Unless WB stands for Western Bulldogs we're willing to help almost anybody. Seriously, and welcome to the board, you have a problem similar to one of our members with wife and children outside of Australia. It's too late to consider what you "should have done", as you say you're dealing with the problem now. Are your wife and children still receiving benefits? Or have they been cut off for overstaying outside Australia? If your wife is working in her home country your problem could be even more complicated. At the moment you need to try to put money away for cheap airfares to visit them and stay the 13 weeks. I suggest you see your local member of parliament, don't write, ring for an appointment. Tell him everything. Go and see Welfare Rights in your state capital, they have a website with phone numbers and addresses. Do you know of a Senator belonging to your ethnic group? For example Senator Nick Xenaphon is of Greek origin. It could help to call them. That's about all I can suggest Alex, Centrelink Portability is only one of your problems, the domestic one only you can handle, I doubt many of us lot here can claim much expertise in that field. thanx for replying guys.i picked up the link on site called centrelink law.i used to visit centreflunk to hope for finding a way to fix my mistake after regret coming back in 2004.not only came back but also force my wife to come back too,force her to leave her parents and everybody in tears.she doesnt wanna go throu same thing again.i cant blame her.because you dont know when you will see these people next time.we cant afford to go there anytime we want.we cant even afford to feed our selfs properly with the benefits here.regards

If you don't do any good there you should appeal C/L decision on the grounds of Family hardship. www.welfarerights.org.au/default.aspx

by the looks of their respond speed,they must be dealing with many similiar cases which there are no other alternatives.still happy to know where i am standing at the moment.here is the mail. Hi Alex, DSP if generally payable for only 13 weeks if you travel overseas. There are two exceptions: if you are the required age to apply for Age Pension (65-67 depending on birth date) or if you're illness is not terminal (2 year life expectancy). Make an application direct to C/L when they refuse tell them that you wish to appeal their decision on Humanity Grounds. Lets us know how you get on.

I'd be curious to know if he's receiving single DSP while wife gets Supporting Mothers benefit, with portability for looking after sick parents in home country. That would be the best scenario I could envisage in that position, takes pressure off Alex to support them while he's saving for airfares.

Hi guys, a couple of questions. I am an Australian citizen with a permanent address ( at present ) and I am on the DSP. In the future I will have no permanent address here in oz and I am hoping to spend as much time as I can ( due to cost of living here on DSP ) in Asia.
If I spend 10/12 weeks in Asia at a time and return, can the department say I am no longer entitled to the DSP as I have no permanent address? Apologies if this question has already been asked and thank you for any replies.

This is the way it's going, stay away too much and you will lose the pension. If you went on the DSP after 2006 you may need to be available for work place reassessment and retraining, which will restrict your travel outside of Australia even further.
At all costs maintain your connection to Australia, Centrelink base residency on this, you need a residential address, not just a postal one and good family connections.
Don't get a full time address in Asia or enter a steady relationship, you will need to prove to Centrelink that you don't live there in preference to Australia.

As many of us have noticed C/L are making up the rules as they go along, this has been proven many times. I am not affected at the moment but I am not making any long term plans, as things with C/L can be changed by some desk jockey who just wants to screw up a person's life. This is why I say if there is a decision made by C/L and your not happy with it Appeal, Appeal and keep Appealing until it goes your way. People on the DSP are being discriminated against & if we let them get away with it the next one will be the people on OAP. Cheers. Banker

Jeez guys that doesn't sound good. Maybe if I only told them every other time I leave the country it wouldn't look too bad. If they stopped your money immediately, what are you expected to live on? Has this happened to anyone on here recently, if so, how did it turn out.

Yes it's happening. Individual cases aren't being discussed on open forum at the moment. Just be careful coming and going without notification, you could also find yourself back on NewStart.
