Thanks mate I hadn't seen that. Although in a recent thread and please don't ask me which one, there's so many on here. I asked the question if anyone had challenged this 2yr rule and Banjo ( I think ) Said that someone appealed it and won.

My change from DSP to OAP was automatic, I just filled in the form they sent and on my birthday it changed to OAP. I am in a different situation to most on here because I was grandfathered in 2002 and because of that I lost my residency. The only things I miss by not having residency are the concession card and medicare when I return to Oz for a visit which is not too often. You receive your payment every 4 weeks instead of every 2.
Since 2002 I have only returned to Oz in 2008 and last year, so I have saved a massive amount of money on air fares, not to mention the pain and suffering I get from travel.

Some years ago there was a guy from Newcastle on a Thailand forum, he had this problem I told him to contact his local member and get a Lawyer which he did and he had his OAP and was back living in Bangkok within 2 months. That was before C/L started all of this current B/S. I put this guys story somewhere on the forum if you wish to do some searching.

If my memory serves me correctly this guy lost the SSAT but Centrelink backed down before the AAT. It made me wonder whether this is a procedure they use so the appellant doesn't actually "win", the guy gets what he wants and goes away and the "rule" is not threatened in the higher levels of the appeals system.

Yes thats the one Banjo, ta. I tend to agree with them not letting it get too far. If they can tell a few porkies and people believe them, they save a lot of money.

Every time an interpretation, by any department, of a piece of legislation is overturned in a higher court chaos results. Long term policy has to modified, staff retrained and people denied their rights previously line up demanding it be rectified.
