That's why I never read that section now. Must be a lot of sections you dont read now. ;D One guy telling everyone how much he knows yak yak yak, yet he dosnt know the difference between DSP & OAP. I spend less time on that forum than you mate, its full of wankers.

As this has gone to the AAT, I think it is very important to understand the case and then determine if it is something that supports the purpose of this forum - to live where you choose... As I understand, the AAT is not a precedence jurisdiction so one 'positive' outcome here may not support any others.
I will read the judgment (publically available on the web) and hope others do as well. And then, I hope to get the story behind the story as the publisher, Daily Telegraph, has little to do with the story and lots to do with winding up the different economic demographics of Sydney siders.

My take, and I've spent three years on this stuff, is that the appellant had no home in Asia, he was not living in Thailand or the Philippines or any other country. The Tribunal determined... wonder what that guy was a professor of? We can only hope it was Law.... that lack of proof of residency in Australia or time spent out of the country was NOT sufficient to warrant them cutting his pension off.
Lets look at Centrelink's options now, do they just say "win some, lose some?". Will they ask for the legislation to be tweaked again? What if they start seriously tracking people they suspect have overseas ties? What would a Filipino private investigator charge to follow some one when he gets off the plane then send photos of a joyous reunion with a little wife and numerous half Aussie children?
Be a worrying thought for a few I would imagine.

OK, just read back through the thread, the professor (she) is a senior law academic. This may make Centrelink think twice about taking it to the Federal court but then logic has never been one of their strong points.

Banjo, As well as your take I would add that the professor also seemed to give weight to the nature of the person's disability, schizophrenia, and the consequent need to keep on the move AND their stated aim to settle in Australia once they gained an inheritance and bought a caravan/motor home...

Yeah, he probably promised to grow his own wings and fly to Indonesia to save airfare as well, Centrelink are big on "stated aims" and then don't believe a word of them.
