Yes mate, we went over it carefully, I even have the full AAT findings somewhere.
Basically, he won for one reason, and one reason only. He had NO overseas ties. I won my residency case in the SSAT for exactly the same reason. It didn't matter what he had here, he had to live somewhere and he didn't live in Thailand/Laos/Cambodia/Indonesia so he had to live in Australia.
This what I've tried to get through to you people on the DSP... YOU HAVE TO LIVE IN AUSTRALIA... THAT'S THE LAW.
Nearly every residency case I've seen crash and burn here, and believe you me, every one has been another hole in my heart, has been lost because Centrelink have known all about the house/partner/boat/dog/car/bank account/ bar in some other country than Australia.
If you're on the DSP every time you get on that plane in Australia YOU ARE ON HOLIDAYS!!!!
How hard is that?
Edit: Oh, and he didn't get the UP, he got his DSP back and is currently under the same 6 week portability as anyone else who hasn't been assessed for the UP.

What exactly are people been denied U/P on ?? And I am talking about people new to the DSP ,applying for it,not those living O/S,or making there way back
Knocked back because they can work,ludicrous as it is,?? Granted it because they can't ? What ?? it's doing my head in.
