Hey Bedwin, It seems to me that various government agencies define residency differently. The Australian Tax Office and Centrelink both have different definitions and rules for determining whether you are resident in Oz. Also you have to listen very carefully to catch whether they are talking about being "resident IN Australia" (ie currently living here), and "a resident OF Australia" (which I suppose means whether you are legally a citizen, with voting rights). It's all quite confusing.

I think you answered the mystery latindancer. That expat website is using "in" Oz to receive Medicare, which I suppose is obvious . . . it is an onshore social service only. As far as CL residency, well, "of" used to be allied to Tax Office criteria . . . but no more . . . now it is a medley of financial and familial criteria guaranteed to keep DSP expenditure onshore.

Hi,Iam nwe to this but have an issue about portability dsp.I have applied and after 3 months got a phone call saying I am still eligable for dsp but not for portability anyone with any info on this topic please let me know Thanks

Your situation is similar to mine, I was refused the UP but kept the pension so I might be able to have some personal input.

Thank you Banjo as I said Iam very new to this site so I dont know what PM stands for ....Well I applied in November last year and just last week received a phone call saying I was still approved for dsp but not for portability.I know in my doctors report he wrote that I did not have work capacity for over 5 years .I have asked for a review but was told it would take months .This is very stressful as I had planned to travel in June .Any information would be appreciated Thanks

If you look to the left of this message you will see two little symbols/icons under my board name. The one that looks like a file is the PM button, just move the arrow to it, it will say "send PM (personal message)" just left click and you can send me a message if you want to. If you have been refused the portability you should have been told what your point score was, it must have been under 20 for one disability otherwise you would have got the UP. When I spoke to Welfare Rights about mine they said that if I appealed to the SSAT (Social Security Appeals Tribunal) then I would need to show that I should have been assessed at the 20 points. I think your best bet is to contact Welfare Rights in your home state and ask for an appointment. They will then go over your assessment result and see if they think it was wrong. One of the problems is that Centrelink won't give you the file on this so you may need to apply for it under the freedom of information Act. June is still 3 months off so they may be able to push things along as well. www.welfarerights.org.au/contact-us

hi,
im new here, and i wasnt able to make a new post, but i was on the disability support pension, anyway, ill start from the beginning.
Ive been on the disability pension since feb 12 2003, due to mental illness (ill be 39 this july)
I left australia Aug 21 2011 to live in sweden. I didnt tell centrelink i was leaving, i just left.
My disability pension was cancelled after 13 weeks but during that time i didnt know about the new portable rules.
Fastforward to now. I want to try my best to get my pension reinstated to me , but i cannot go back to australia due to the fact that i just dont have the money. Centrelink has a history of my psych reports that proves i am unable to work, and i had a psychiatrist report done before i left australia. Do my chances seem good to get my pension back?
also, what should i say? I have no idea, I am also living with a man, should i be telling them that? (my gut feeling says i shouldnt]
I hope i have covered everything, so i can get an answer. I am also an australian citizen, i was born in Redcliffe.

I would say that you would have to return to Australia to reapply for the DSP. Ring Centrelink from Sweden, there is an international number on their website, and confirm this. +613 6222 3455 You would also need to convince them you are an Australian resident, difficult after 18 month away. DSPoverseas encourages members to be completely honest with Centrelink regardless of the fact they don't offer us the same courtesy. I see Sweden is not an international agreement country so if your pension was reinstated you would be bound by the 6 week portability rules. Good luck and get back to us on any developments.

banjo,when i look on the computer it says australia has an agreement with japan,but c/l tells me it does not,now if it does what does that mean ,how does that work can i go and stay more than 6 weeks,
