We can now say we have official cofirmation that the portability is 28 days paid in a 12 month period. 13 weeks unpaid while under suspension that may be taken in conjunction with the paid portability. The pension will be restored if you return to Australia within this period.

So is it possible to apply for an extension in the portability period and get your DSP paid for the full 13 weeks rather then just 4 weeks? l wonder what grounds they would accept for an extension? what if your only close family was overseas and you wanted to spend time with them rather then just a holiday?

It looks to me like you have to apply for a paid extension before you leave.
I doubt that spending time with family would cut it but it's something you need to ask them yourself. A close family member in poor health may work.

Just finished getting off the phone after an hour waiting. I am finally getting the forms sent out for unlimited portability. The person talking to me gave me a 4 scenario outcome. She said 1. "You may get unlimited portability." 2. "you may get portability for more than the current 4 week limit." 3. "You may only get the current 4 week limit" Or 4. " You will lose you DSP altogether."
You got to love the scare tactic of scenario 4. Anyway, I await the forms and will keep the forum up to date with the progress.

For what it's worth I would be querying scenario 4. Sounds like more lies to me just to put you off. Surely if you are entitled to the DSP you are full stop and then just because you pick your nose you will not lose it. Again this should be totally taken to task and if incorrect the person should be sacked. But we know from past experience this will never happen but if enough of us take up their time making them investigate all their lies then maybe over time somethings will change. If I am disabled i can get the pension. End of story. Claiming UP cannot possibly cause a reversal in that.

Thanks nomadic, I agree that it shouldn't be an issue because the assessment has already been determined on a previous date, However like blahblah pointed out the bar has been raised and this will eliminate a lot of low end dsp recipients. Thats also why understanding the tables and where my doctor needs to be on this. I really only have one shot at this regardless of appeals and how long this takes so I want to get it right at the get go.
I'm still waiting on paperwork to arrive to get the ball rolling. Will keep the forum informed as we go to hopefully help others. wooly.

Not sure if it's the same but after i got UP i asked my lawyer what would happen if another government changes the rules?. Will i come under the new rules? He said that i shouldn't worry as they can't keep changing the original decisions all the time. And while i stand to be corrected i would have thought that they can't keep reacessing everyone once you are on dsp. If that was the case they could make it impossible for anybody to get DSP and reacess everybody already on it. thus eliminating it altogether and that will never happen. Maybe if this has happened to someone already i will change my opinion. You are doing the right thing wooly and seem to have the patience to get it right the first time. Good luck as the feeling of getting UP is euphoric. Never has anything other than a brain haemoridge changed my life as much. A million tons of despair was lifted off my back. May you get the same result.

Hey guy's and gal's. Just reporting in with my progress with DSP UP and I'm still waiting for a reply of some sort. The forms arrived about a week after asking for them on the phone. Filled them out the best I could, Instructed the doctor where he needed to be on the spinal tables. Hopefully will hear back soon for an interview. On a side note, My wife has recently become my carer as she is needed for certain aspects of my disability. Anyway, that all went through ok. She was granted allowance and carers payment. We got married in July of 2012 in the Philippines and her visa was granted and was in Australia on 24th jan 2013. My wife was only here a few days before I took her to centrelink to report her arrival and update my status. She also got a medicare card while we were there.......Anyway, To cut a long story short. I noticed on my centrelink online profile that I apparently owe them over $16,000.00 I'm obviously going to take this as far as i can with them but I can see i'm going to have to get a lawyer on this one. They are stating that I have been over paid as a single since july 2012. That might be how it appears on the computer but I reported my status (all be it 5 months late but she wasn't in the country or had an income) In person with my wife present. I can see i'll have to get all my records which include visits to them. Just when you think you are going forward, These useless good for nothing vermin at centrelink ruin it for you. They are fair dinkum useless.. ok, rant over.

Go for it Wooly. Everyday there there seems to be a new story of injustice with C/l and either their incompetence or total deceipt. Yes, lawyer could be invaluable and either of you will need your entire file under freedom of information. This will take a needless amount of time but will be worth it in the end hopefully. And if so seek compensation also for time and stress. Yes indeed they are the vilest of vermin. Can anyone really believe this happens in a developed country? Only when you are affected by it I guess. Everybody else can't even contemplate it. Same as Science fiction to most.

See Welfare Rights before forking out money for a lawyer, they may have a quick fix.

If centerlink knew you had a missus and she had no income and was not in the country they should of granted you a section 24 on the basis that your wife was not in the country and had no source of income id be asking them to waiver your debt and ask them about the section 24 provision if it goes to the ARO thry will most probably rubber stamp the ODM decision but im sure u could win the Section 24 provision in the SSAT
