Yes snooks I am in Tassie One problem I have had in the past is not qualifying for Legal Aid because I dont have a pension card but I will try again

I used legal aid just after i started on newstart. It was regarding a contractual matter. Unfortunately they could not help with that type of matter but they gave me guidance right up until that point and in pretty quick time

At my recent review, level 1 AAT for indefinite portability,
The memeber said " It is not the test , that noone would employ me , aged 60 yo, and with my disabilities. Even if i am unemployable in a practical sense, the legal test is whether or not i am capable of any work within the next 5 years from the date i applied for unlimited portability. " JCA said i have baseline capacity b 0-7 hrs work per week, and even tho my GP and clinical psychologist both certified incapable of any work over next 5 years, the memeber says this runs contrary to the evidence in the last JCA "
Oh well , off to level 2 AAT

Just an update... I had an appt with my DES provider on Friday, took an advocate with me and I think I am on the way to getting an exemption to the POS. The provider applied to change my capacity based on the lvl 1 AAT appeal and incorrect information being applied. It appears CLink assessed me on feb 14 without contacting me. I should know on Tues (mon is a public holiday) and if my capacity reduces they will do the exemption without an eSAT... they were concerned that an eSAT could increase my capacity even though I now have 25 impairment points.

It appears my capacity didnt change with the change in circumstances so they are now going to request an eSAT. Will see what happens now I guess.

Ok... so today I called the complaints line and apparently there 'may' be a quick fix for my DSP application. Because I previously requested to exit my voluntary program of support on health grounds but the provider sent a letter just saying I exited at my request... if I can get the provider to do a stat dec stating that I ceased participating on health grounds my DSP will be granted! Then I wont need the 2nd AAT Appeal or a new ESat... It all seems a bit too easy after all the mucking around but I can only try!

Wow... what a difference when someone that lodges your documents actually tries to ensure things are done as quickly as possible... My letter from the DES provider was submitted and I should know this week if my DSP has been granted due to having been exited on medical grounds. The lady at clink also suggested getting back in touch with the MP I spoke to as they can also escalate things.

I'm not sure at this stage... all I do know is that the DES provider doesnt particularly want me on their books becsuse they arent going to be able to claim 'success' lol The MP I spoke to is also following up on my behalf so hopefully something will change.

I should have known it couldnt be 'that simple'... apparently my claim is now being dealt with at 'level 2' but that means noone but my claim manager can update or speak to me about it. Apparently next week I should hear 'something' but it wont be a priority because I receive 'something' (something being $35 a week newstart)

Now it appears that CLink dont know why I was asked to provide the letter about exiting the program. Apparently it is unlikely that they will do anything with a claim on appeal. I've spoken with advocacy and an mp but none of us can figure out what is going on. Waiting to hear back from the mp and lvl 2 complaints prior to my case conference with the AAT 2nd review next week.
