I am not sure if this is the right place to post so Banjo please move if posted incorrectly I know of a person who was a full time carer for a parent, they moved away and informed centrelink of the changes and the fact that they were no longer caring for the parent. Centrelink continued to pay carers payments so the person informed centrelink again. The payments finally stopped and all was fine for a while then he got a letter telling him he owed them, he appealed and they agreed that it was their error and that the money no longer had to be paid back. Months later and they have decided to reverse the decision and have again told him he owes the money back to them regardless of the previous decision. I was of the understanding that no matter what, if the error is theirs and you have no way to pay the money back they had to remove the debt because it was their clerical/administrative error which should not have happened due to their procedures. Where does this person stand in regards to the over payment and changed decision? I have advised to call welfare rights and also to find out what he can about the law and admin errors for centrelink.

My own experience with this type of thing was many years ago. After i returned overseas on one trip they continued to pay me rental assistance even though i told them i was leaving and they know anyhow with immigration. A few months later they asked for it to be repaid. But not my fault and money spent as i had no idea overseas i said. Never heard from them again.

The thing is they agreed it was their mistake and said he did not have to pay it back but now he has moved they have reversed their decision. Can they do that?

mspurple did he get a letter in writing stating he didn’t have to pay the money back? If so, I cant imagine they will be able to make him pay it back. Hopefully it is a clerical error due to him moving. Definately reccommend talking to welfare rights.

How long ago was he advised that the debt had been waived? If it was within 13 weeks then Centrelink have the same right to reverse a decision as we have to request a review. If not then he would need to follow the same steps as if requesting a review or appealing any decision. Hopefully he has a record of them advising his debt was to be waived because if it gets to the point of an appeal it should be in his favour.
If he does request a review I would also suggest he requests his file under freedom of information - it 'should' include something that shows the debt was waived. He would need a record of when he contacted them and when he was informed that the debt was waived.
He should be able to claim that he received the payments in good faith after notifying Centrelink and had made no provision to repay the debt after being advised it was waived.

Try using another browser. Very rarely Firefox produces strange glitches with some websites so I just switch to Chrome.
