I just rang ICL to check in. No problem to be reinatated but they ask a strange question.... do i have permission to stay in Australia. When the girl asked what was my future intention I quoted your... legislation....and she dropped the subject very quickly.
i am going to be very interested to hear what the member who checked out again on portability had to say,

Dont give these bastards at Centrelink an inch, only answer questions you have to.
When they ask me a question I usually reply with a question like "Why"

I did ask permission from whom do I need permission to remain in Australia? She dropped the subject. Very nice girl and extremely helpful in reinstating my pension and doing my on line loan for some dollars.

Your right to remain in Australia is an inherent right (not a privilege) that comes with being an Australian citizen. You do not need the permission of anyone.

However, why are they asking this is a bit of a mystery, Checking for people who they have deported, but are still paying a pension to? Launching a witch-hunt against Australian citizens to weed out any mistakes on C/L's part is a pretty lame thing for a government to be doing to its people.

yes good question lynne.i have been back since the 1st feb,i want to go back o/s but when they talk to me they told me not to try for a few months,i only spent a couple of months in aust in the past year,so i also would like to know what the go is?? i tried to talk to them but know i have to talk to a specialist on that.will ring next week,trying to find out more before i ring.so anyone who has left recently any info would be appreciated thankyou!

There's only one way to know for sure Lynne, and that's tell them. I'd go in personally and if they mess you around ask for the decision to be reviewed immediately by the officer's team leader. If it's upheld then you ask for it to be referred to the ARO. Get everything in writing.

anotherdsp Thats a starter but I think we need a central board for ICL's comments re members leaving again so we can be prepared. Seems there maybe different answers depending who you speak with at ICL. Its' getting like chook lotto. ..................

It could be good, it could be bad and it could maybe be a maybe. I had an "expedited" ARO decision last year that was promised in the same week as I had had my pension cut off but it still took 10 days. I would say that they had spent some time on it because part of the decision was that although I wasn't an Australian resident I wasn't a resident of any country either. So he partly supported his officers decision but literally torpedoed their case in the SSAT. I posted part of the ombudsman's report on Centrelink(2011) this week where he goes into the time taken for appeals and reviews in some detail. We may not agree with their decisions but they have put a lot of thought into them, particularly in a case like this where we have done a lot of cage rattling with newspaper letters to the editors, Senate submissions and harassing our political representatives.

The purpose of this forum is to discuss members issues with Centrelink. While other topics may have some relationship to these issues I can't see much point in discussing them in any depth. There are other forums that welcome varied political points of view but I don't have the time to bother moderating them here. Such topics can be deleted without warning or explanation.
