So you think the 6 week portability will be just a shortened version of the 13 week rules, I understand from Centrelink that the reqirements for being deemed a resident will be strengthened .... living outside of Australia for longer than 6 months will get you classified as a non resident and your pension will not then be payable. I understand this also was the case in therory for the 13 week rules but the time spent overseas was never clearly stated in only things like having a bank account etc. I believe that from 1st Jan 2013, Centrelink have much more power to cancel payments if you are deemed to be living overseas more than 6 months a year. So those DSP's who think they will be able to ping pong every 6 weeks beware, I do not believe it will be allowable, this information was given to me by CL staff at Darwin, who seem to be pretty up to speed on the new rules.

The 13 weeks out of Australia was always clearly stated as it was written into the legislation. The 6 weeks portability is also plainly set out. However at no stage has a minimum period that has to be spent in Australia ever been mentioned. No doubt the highly up to speed staff in Darwin are telling people about six months but until I see it in writing I'll personally remain unconvinced.

lol had to laugh at Darwin being up to speed ;-)
I hope you say how this information was obtained as that does seem an over the top statement by c/l. unless it was made by the front line plebs which IMO should not be recommunicated in forums to justify anything let alone a warning to not travel.

As banjo says .... the proof will be next year .... I asked the question and that what I was told .... and only in my last 2 trips to Darwin CL offices have I had problems ... eg reviewed, cancelled, reinstated due to CL agreeing that I will be able to move to OP within 3 months

I am not doubting what C/L have told you but it has been proved many times on this forum where most C/L staff "Dont know their Ars from their elbow" and will just give you any answer they want to to get rid of you out of their office, because you are causing them to work. They want to get back to ZZZZZZZZZZZZZZZZZZZZZZZ
Always get any important decision from them in writing, if they wont do that you will know something is not right.

Is 6 weeks rule only bang on six weeks , or is it like the 13 week law ware you have the 13 plus 13 more with out the extra benefits giving you 26 weeks .will there be that extra 6 week without your benefits,effectively giving you 12 weeks.

I asked C/L that ! & the lady at international told me that DSP was to be paid for 6 weeks whilst you were O/S & you got another 6 weeks to be back in Oz, otherwise you had to re-apply.
So yes 12 weeks in all, 6 paid + 6 not paid.
I was worried that if u cut it close to 6 weeks & had some mishap youd be cut but they give a bit of leeway.
