But if I ran C/L and anyone was granted U/P outside the specific criteria...ie...you are dead.....then I would have them so wrapped in legal blankets to not say a word that they would not even be able to fart without me...or mine....smelling their stink.
Just go for U/P....whats stopping you?

thanks mate, i obviously didnt come over to well with my rants. And fair enough. I guess you had enough guts to try for U/P ,even though you probably could have waited it out for old age pension. To pave the way. so to speak ,i respect you mate, starting a board like this and reading posts like mine.

good luck Banjo...my S.S.A.T...Failed.....they somehow got into my old family law court cases... and said I leased land...o/s...but they still can't prove I'm a resident anywhere but Aussie...but time away is enough...they make the rules...and change them when they want.. OH NOOOO....don't think Human Rights mean anything...bring it up and they don't care..cheers...where's my depression pills.......

I'm not in that bad a situation Bundy, the assessor upheld my eligibility for the DSP in her report so this is the only issue I have to worry about unless they push my residency buttons again. Even if I stay in Australia next year I have the advantage of taking a negative ARO decision on the Unlimited Portability to the SSAT while not having concerns about losing my pension. Plus I turn 65 as well, I'd like nothing batter than taking an appeal to the AAT from the comfort and mental tranquillity of an Asian country. My principal argument will be the similarity of the DSP impairment tables and the criteria used for the UP, if you qualify for one, you should be eligible for the other. You're still trapped in the residency quagmire, and like Lynne, if they have proof of strong residency connections to another country it gets hard. Do you plan to take it further? I think you should talk to your MP anyway... make an appointment, don't write in this case.

thanx all...wat annoys me is C/l..s.s.a.t...all of them never once asked about my health,disability...or what I would do..I think I'm done like a Sunday roast...They have an agenda to get rid of as many of us as possible..The S.S.A.T..Said they posted their decision on 16th September...never even got it..after telln them to email it.. they emailed me after,telln me they can't email me..even though C/L..Emailed me all decisions..they are worse then what they use to be..They haven't even told me what to do next..They said no assetts in Aussie ..but I informed them lawyers took all..over 5 years..in Family court..which is very flawed.And they even got information from the court...get the Zoloft...out...OMGG...cHEERS ALL..WHERE'S THAT WHISKEY..

to bundy, it is strange that they said they cannot email the decision,i had mine down decided and sent within 24hrs of the hearing and notified by email?
i think we have to have very good ongoing ties to home and no ties to o/s except just like a normal tourist,that is what they are looking for in these residency cases?
if you go to the AAT i would be looking at strenghtiening my home ties to aust( i.e a permanent residence in aust that would help??)

Residency is about where you live, not disability. You can be a blind quadriplegic with hay fever and you would still lose your pension if they though you were an overseas resident.
I've never received anything by email from Centrelink other than the most basic information.
