· have made enquiries and have the following information. Most of which I am sure you are aware of.
Firstly, you can go overseas for 13 weeks at present and yes, as at 1st January 2013 it reduces to 6 weeks only before you are cut off from the DSP unless you have the ‘no future work capacity’ portability.
Secondly, if as you say, you definitely cannot work because of your condition you should have no problem passing the medical as per the statement below:
'no future work capacity' portability provisions
From 1 July 2012 a customer is allowed indefinite portability of Disability Support Pension (DSP) if they are either:
• assessed in Australia as;
• having a 'severe impairment' and that this level of impairment is likely to remain for at least 5 years, and
• having no (less than 2 hours per week) future work capacity independently of an ongoing program of support and that this level is likely to remain for at least 5 years, or
• Assessed as manifestly qualified for DSP under the current manifest guidelines.
Further information:
· After 1 July 2012, if a customer intends remaining outside Australia for greater than 13 weeks, their DSP may continue indefinitely if they satisfy the 'no future work capacity' portability provisions. This will usually require completion of a medical review, which will include a medical report by the customer's treating doctor and a Job Capacity Assessment (JCA) that must be conducted before the customer departs Australia.
I cann’t see you having a problem unless of course the result of the medical assessment is that you no longer are considered to satisfy the medical qualifications for the Disability Support Pension AND the portability provisions ‘no future work capacity’. This does not mean you will lose your DSP which does allow you to work a certain number of hours a week if you so desire, but will after 1st January restrict you to 6 week holidays outside Australia.
