Anyone found out exactly what happens if we stay overseas past the 6 weeks? I been tryingto find out from centrelink but not having any luck. do payments stop completely?does a person lose the dsp?
under the old 13 week rule, if you go over 13 weeks your payments would be reduced, but you could stay overseas up to a year on reduced payments. But now?

I stayed 2 days over now i have to fly to Darwin to be reinstated.

Centrelink told me this month that you still have 13 weeks unpaid when your 6 weeks runs out, then you lose the DSP and have to reapply.

Hi Gang,I was told that after 6 weeks your payments stop completely ,then up to 13 weeks to contact c/l back in Aus, and being in Aus to go back onto your existing payment , without an interview , after 13 weeks to 1year you can reapply using your existing info too be reinstated ,after the 1 year you have too go through the complete ordeal again . dose this sound right or have I missed something ,

I'm not sure it's that easy to be reinstated after 13 weeks to one year away unpaid. I certainly wouldn't chance it unless I discussed it with Centrelink before hand and got some sort of written commitment. If you have to reapply under the new legislation you could very well find yourself looking for a job.
And what about residency? If you're away for a year do you think Centrelink would still consider you a resident? I'd think twice before I even risked the 13 weeks unpaid.

So are you saying you wouldnt risk going under 13 weeks or over 13 weeks? It should be okay if you return before the 13 weeks are up right? Also when they ask u where your goin they usually ask which country your goin to. last time I said Im goin to a few and she said various countries then, previously they wanted to know which ones but prehaps it was the wording of it and the way you respond...

Keep that "various countries" answer.
I think that the time away thing, over 6 weeks and under 13 weeks might work once every couple of years, the 13 weeks to 12 months thing may not work at all.
I really don't know, I don't think Centrelink know.... what some may get away with another won't.

I remember telling C\L I was going OS about six weeks beforehand early Last year 2 weeks later I was sent a review of dsp letter 4 weeks before I was due to leave, it said I would have an interview after my return date I was away for only 2 months, when I returned they said I had no Interview.. When I left again 3 months later I gave them notice 2 weeks before I left..Nothing happened. I never went over the 13 weeks before. Im going to be going over the 6 weeks a few times this year, I'll let you all know how it all goes!

Hi banjo,yes i agree after the 13 weeks is very iffy ,I have no intention of exceeding the 6 weeks at this stage , what i said before was what they stated to me at C/L ,No intention to push my luck.also when they ask where you intend to travel they have a travel history on there screen from previous travel anyway from customs,keep up the good work ,

I have just received a letter for my forthcoming travel plans and it says very clearly in bold letters
"after 42 days outside Australia your pension can NO LONGER be paid "

Zorro just wondering if your staying over 6 weeks or under? About the customs thing I thought C/L only know when you leave and return to Oz? They dont know every country you go to unless they cheak your passport..not sure though. ASIO would know..

takeo19 im staying under 6 weeks. I dont think they know what countries you visit so for example if you fly air Asia to Malaysia you can say your going to 'Malaysia" because you are. Make sure you stay 1 night before going back to the regular haunt eg Thailand to be safe. i have tested the above theory and how could they possibly know without checking the passport as you say.

Hi I am Glen. Newbie. To all you guys, the correct answer is 6 WEEKS only. from Jan 1st 2013. I have rang up C/I twice. go to the Faschia website and type in portabilility rules. the only way you can go more than 6 weeks is to apply for indefinite port. in other words you are leaving Aust permanently with no capacity to work in the the nxt 5 years or terminally ill, dying within 2 years, to go back to your country of origin. If you risked going over 6 weeks, good luck when you come bk to Oz. your DSP will be cancelled. you will have to reapply under the new impairment tables, which is tough. I have read the lot. By the way has anyone been successful applying for indefinite port, yet? I am getting my docs together. If someone has, pls let me know what's the assessment like. Cheers!

I dont think thats correct glen, Banjo was told by C/L you have 13 weeks unpaid after the 6 weeks and then you have to reapply..anyway Im about to find out soon. Ive heard of people coming back late and they dont have to reapply, I think your payment is restored the day u arrive back in Oz.
