DSPoverseas Newsletter. March 2013
Disability Support pensioners who wish for the right to travel are now entering a disquieting phase of the battle for unlimited portability.
Last year we had serious concerns that the new legislation was being interpreted by Centrelink in a way that would make it virtually impossible to achieve by anyone capable of travel. Now we begin to have a small number of members successfully acquiring it.
We need to get a full picture of who has applied and with what result and to this end I’ll be setting up a poll in the next couple of weeks and sending out a link to all members. I expect that everyone involved in the new portability, or even considering applying, will contribute. This is the only way that we can keep check on what’s happening with our membership and plan the future direction of the board. The information will be used to help applicants prepare for the assessment process and give them an idea of how the impairment tables are being interpreted.
Recently the forum acquired a new member with considerable media experience and skills. What we want to do is build up a log of members stories; what the portability legislation changes has meant to them and the effect it has had on their lives and of those they care about. Be assured that nothing will be published openly or used in anyway until it has been discussed with the person involved and their wishes adhered to. Name changes and other editing to protect people’s identities will be assured. One option is that some of the stories will be used on our website, AustralianPensioner.org, another is that suitable items be made available to the press. Anyone with something to contribute please contact me through the dspoverseas@gmail.com email address or send me a PM through the forum and we’ll work from there.
Centrelink continue to refuse most if not all requests for overseas portability extensions through ill health. We currently have a member who is stranded in Indonesia after losing her payments, placing her in a situation that must eventually involve personal risk. Be warned.
Membership has boomed this year; more people are concerned with their rights under the Social Security Act and we have done our best to help them and direct them towards professional advice. Sometimes it's good just to talk things through and we certainly do plenty of that.
With the approaching Federal election the administration has allowed political discussion on the forum. This has gone well and has been conducted in a well-mannered and often informative way by contributors. If you have something to say feel free to come along, just be aware that sexist, racist, abusive or any other offensive posts will disappear as quickly as Banjo or Banker can reach for the delete button.
Stay safe,
Banjo.

banjo, what the changes means to me is,well i dont want to live overseas, but i have a fiance overseas and our plan is for her to come to australia, but there are a lot of things we need to do first,so i was going to go over there for 3 months and in aus for 3 months mwell i did this twice and then they put on the 6 week rule ,so i cant afford to travel now its just to much,so i have a fiance that i would dearly love to be with and her country would allow that but fu en aus gov say now way,so we are stuck miles appart, its crazy why wont aus gov let me go for 3 months or longer at a time ,im just sitting here doing nothing just waiting stuck in limbo.

I think you sum it up well for a lot of people Terry, I can't see why the long term DSP shouldn't qualify automatically. After all if there was a job for us we would have had it years ago.

March 2012 applied for DSP ,denied on grounds of able to work up to 15hrs,REAL PIECE OF WORK THIS ONE
April 2012 appealed ,stated my health is deteriorating, and won't improve over next two years as evidenced,REALLY NICE UNDERSTANDING LADY WITH GENUINE EMAPTHY,AND CONCERN
One week later GRANTED AND BACK DATED TO INITIAL APPLICATION
OCT 2012 APPLIED FOR U/P
JAN 2013 JCA told them had two super funds and two TPD claims pending and five year box ticked by doctor and condition confirmed an likely to deteriorate.THIS,GUY HAD BAD VIBES,PLASTIC SMILE ETC
LATE FEB RANG INTERNATIONAL FOR UPDATE,WAS TOLD APPLICATION DENIED ,went to local office asked what was going on,They got on the pc,and the phone,we're told was not the case, and it was still, under review, said I want to lodge a complaint ,given num, lodged, was rang the next day and given a halfhearted APPOLOGY.
Rang again last week for update, told denied, because assessed as able to work up to 15 hrs per week, still keep the DSP, 6 week Rule
LODGED AN IMMEDIATE APPEAL
NOW THE NIGHTMARE BEGINS, AS WITH UNNECESSARY STRESS
GOOD LUCK TO ALL THAT APPLY

In this letter they state I did not wish to submit further documentation,I asked them like what,it is basically the same info as last april, with the addition of the five year clause and impairment will deteriorate, said to them all info required was sent.said will contact doctor, said fine, found out doctor had left practice 3days before.. rang to tell them, they said they know, and because they couldn't contact him they made their condition to deny based on assessed able to work up to 15hrs the way these scum word it puts you in a bad light LB 3 Regents Park DC NSW 2143 Dept of Human Services PO Box 7809 Canberra BC ACT Australia 2610 Fax: (613) 62222799 Telephone: 131 673* ♦Call charges apply for '13' numbers arid may apply for '1800' numbers. Office Hours: Mon-Fri 8.00am-5.00pm 20 March 2013 I am writing to you about the portability of your Disability Support Pension (DSP). Generally, DSP may be paid for up to 6 weeks of a 'temporary' departure from Australia, or is not payable at all for a permanent departure. You may be paid DSP for longer outside Australia if you are assessed to have a permanent "severe impairment", and no future work capacity. The Job Capacity Assessment provider has assessed that although you may be prevented from undertaking fulltime employment, or employment that involves manual labour, you would be capable of undertaking suitable light employment on a part-time basis. As per our discussion 17 March 2013, you did not want to provide additional medical information. We attempted to contact your treating doctor, who was unreachable as he has left the practice that you attend. As you have not been assessed to have "no future work capacity", you are not eligible for indefinite portability of your Disability Support Pension. This means that if you leave Australia permanently your pension will stop from the date of your departure, or will be payable for a maximum of 6 weeks of a temporary departure. This is an information notice given under social security law. What to do if you think this decision is wrong If you do not agree with this decision, please contact us and we will explain it. We will reconsider your case and change the decision if appropriate. If you still do not agree, we will tell you about other avenues of review that may be available to you and how you can apply for them. It is important to ask for the decision to be reviewed within 13 weeks of receiving this letter. Your right to privacy Your personal information is protected by law and can only be released to someone else in special circumstances, where Commonwealth legislation authorises or requires, or where you give your permission. The law does, however, allow Centrelink to check the information you provide with other organisations to ensure that you are being paid correctly. If you have concerns about your personal information, call us or come in and see us and ask to speak to a Privacy Officer. We can advise you of your rights if you wish to see and amend your information under the Freedom of Information Act 1982. You can get more information by going online at www.centrelink.gov.au and accessing our factsheet entitled 'Your Right to Privacy'. You can also request a copy by calling us or visiting your nearest Centrelink Customer Service Centre. And as I have stated time and again, how is it two super payouts and two TPD payouts which by law require you to be incapacitated with no work capacity ever in any field or training IS TOTALY IGNORED AND PASSED OVER

They are just pen-pushers and box-tickers whose only real concern is retaining their own jobs. Perhaps contact the ombudsman ?
