Hi all, im new to this board & have been trying to sift through the massive amounts of info here and on other sites. I know I could find some answers but Im very limited with internet time-basically 1or 2 quick log ons a day. my basic story/question is this- 20 years of mental illness(several hospitalisations) and 10 years of back problems(4 different surgerys,chronic pain with addiction issues-great stuff that oxycontin) I was granted the dsp in feb this year.assesed as having zero capacity for work at a jca. would any one care to reckon what my chances of now getting unlimited portability might be? Im a 45 yo single male,i struggle to make ends meet and care for myself daily- friends and family have been recommending for years that I live/visit in se asia (Vietnam and or Indonesia)long term where I could not only cover living expenses but also afford to pay for cooking and cleaning etc I have got the paperwork from international services but want to make sure I do everything right the first time thanks

Given that you have been assessed with no work capacity under the revised impairment tables you should qualify. Just check that you scored 20 points under only one table then you are clear to fly.

Welcome to the board Jim.
UP is based on the impairment tables, minimum requirement is 20 points in one disability. You need to see your doctor/psych and ask him if he thinks you will qualify.
I'd say that you would have a good chance, the JCA will only look at one disability though, your back or your mental health issues. You need to discuss this with your doctor.

thanks for the quick replys- will centrelink tell me how many points I got,or would I have to do a foi request?
this government...... I wonder if mr abbot would give me a job ? or a university scholarship like his daughter

ive found a copy of the tables-so thanks but yeah ,centrelink have said it will take at least 6 months to assess me. just sounds like more red tape they make you jump through in the hope you will just go away

Centrelink will tell you how many points you get. It works in 5s, 5-10-15-20
If you get 19 they call it 15, the goals posts are moved regularly.

I wonder if mr abbot would give me a job ? or a university scholarship like his daughter Yes Abbott has three daughters in their early to mid twenties , one has a nice job overseas at the Aussie embassy in Switzerland, the other one at BMW car company and the third got the $60,000 scholarship even though other kids in her class got far better grades. Centrelink will tell you how many points you get. It works in 5s, 5-10-15-20 If you get 19 they call it 15, the goals posts are moved regularly. I didnt know that, so you can get one or two point for certain things?, for example, if im in the over 20 points in one category section, then i may actually have 23 points or something like that?

Sure, when I did my JCA I was a 10 for one, and 5 for the other but they gave me an extra 5 for being a pain in the arse so I missed UP but kept the pension.

Hey jimthirks, (For what it is worth) I applied for and was granted the DSP back in October 2010 on 3 grounds. Interestingly I also applied for Unlimited Portability in early 2011 as an "act of grace". I received a phone call from the secretary to the minister at the time who told me that my application had no chance and did I wish my request to be noted on my file or dispensed with. I told her to record it. I re-applied and was subsequently granted Unlimited Portability under the new rules in April 2013 and I left Australia in August 2013. In my original application I was allocated 40 points for one impairment and zero for the other 2. In my 2013 JCA they knew from their system that I was entitled to 20 points before the interview even started. What I had to 'argue' was that the other 2 grounds in my application were worthy of consideration in determining my inability to work. And I have no idea what points I am currently allocated. Hang in. Stick with what Banjo suggests and enjoy the company. Cheers

It's strange greenman as you say you applied for unlimited portability in 2011. Strange as the legislation was not introduced until 2012. Therefore the only way to get up was to have a terminal illness (in the final phase) and locate back to your former country or be severely disabled and move to an agreement country or qualify under Mr Borrowman's circumstances.
The current legislation for unlimited portability had not even been introduced to Parliament yet.

Totally agree immiadvice, I don't have a copy of the letter that I sent to The Minister and the Department Secretary at the time but I made the request for Unlimited Portability by suggesting the Department Secretary could utilise the "Act of Grace" provision in the Social Security legislation which authorises that person to make a decision outside the normal rules. As you correctly point out there was no legislation, other than terminal illness provision, at that time and my request was rejected. And I am sincerely grateful to Banjo and others for their contributions in ensuring that the current portability legislation came into being. I did not find DSPoverseas forum until April 2012 and perhaps if I had been aware of it in 2011 I may not have applied as I did. But at least they didn't bin my request and they did telephone me. Though why I was given the option to have my request recorded or not is still a mystery to me!
