I'll try and make this a shortened version I've just received the ARO decision that I dont meet the impairment points for DSP. I have Rheumatoid Arthritis, Fibromyalgia and mixed depression/anxiety (adjustment disorder). All 3 have been diagnosed as required, but apparently the depression/anxiety is not treated and stabilised as at the time of my application I had not been diagnosed for long enough. I do not meet the impairment points. I have 15 points and apparently a capacity of 15-22 hrs a week within 2 yrs with support... I am planning on appealing and have an appointment with welfare rights next week but I would really appreciate any advice on how best to approach this. My original application was in October 2015 after I was terminated from my job due to being unable to work full time. That application was 'lost' and I reapplied in April 2016. I had a job capacity assessment in June and requested an ARO review after that. I have a complex claim as I also own 2 businesses (although I do not work in them). Anyway... thats me! Healthy until late Dec 2013 and then everything came crashing down with the acute onset of severe rheumatoid and a later diagnosis of fibromyalgia, losing my job and now going through this process as a 'first time' welfare applicant. Thanks for reading, Jo

Hi Jo, Welcome to the forum. You're on the right track with Welfare Rights. I don't have any experience with DSP claimants who own businesses -- all I know is that there's an assets and income test separate to qualification criteria for DSP -- but there may be members here who have some experience with how this works.

Thanks Murphy... I'm ok with what I need to provide for the income and assets as my husband is also my carer - so we have to show we meet the threshold for that anyway. It just seems ludicrous to me that CL accept that I need a carer but contradict their own information in denying the DSP. At the moment am just going to focus on the impairment points and what parts of the denial it is best for me to dispute.

Gathering together your evidence of your functional impairment(s) will help Welfare Rights to work out how to best advise you.

Welcome to the forum tasjo, as you say your case is indeed complex.
Centrelink should have ignored your business ownership other than take the income into account but maybe a suspicion that you are contributing some work towards them may have entered the equation.
Their general attitude is that you are guilty until proven innocent.
Going to Welfare Rights is the best start to your appeal campaign.

CL have just asked for proof of income (or lack of lol - from the business, it just cant be assessed by the 'normal' team.
