Welcome to the board bundy. I wish you luck trying to get grandfathered I've never heard of anyone getting it retrospectively and that includes me. You need to have the decision reviewed and start preparing an appeal. There's a lot of stuff on the board here about residency and if you take a look you'll see what you have to start doing. Check the website for a few pointers as well. www.australianpensioner.org/residency.html(Don't forget to click on a few ads). We're all in the same boat here so if you have any problems or just want to talk about it get back to us.

Hi Banjo..and all..yes they said I wasn't a resident but couldn't prove I was a resident anywhere else. my passport shows I travel..16 days in Philippines in Feb:twice to Lombok in March''last year Flores,Sulawasi Surabuya...etc:But as you know they just wouldn't listen to me.I have not had to do any medical checks for years..I have an incurable disease, and many other ailments.I know the deal have done reviews and appeals before.Been dealing with them when the dole was $3.50 a week..Also have paid around a MILLION dollers in taxes...they just don't care.I lost everything to lawyers in a messy divorce. So now no income ...nothing..OMG..i'LL sort it out.take care alll...

Been there, got the teeshirt. You seem to have an extremely important point in your favour, no provable overseas residency. They are going to try to nail you on frequency and duration of travel so you have to keep politely asking them what the law states in exact terms on this. There's a group called Welfare Rights who will be prepared to represent you in this matter. there's a link to them in "links" on the forum. I never got a lot of sympathy from them but they may have changed their attitude after I won my appeal on residency without their help.
Edit: And another thing, you need to ask for your payments to be reinstated pending appeal, if they refuse and offer you NewStart think carefully before you accept, you could end up running around doing Job Assessment Capacity bullshit.

Welcome to our forum bundyrum. Get a copy of your file from F.O.I. it takes about 28 days to receive it. Then go through it to find out what C/L have been putting in your file and take it from there. You can fill in the form online and send it. www.humanservices.gov.au/corporate/freedom-of-information/Then appeal any decision that C/L make & your not happy with it. Please keep us updated on your progress.

Bundy, I saw what you said on another thread... have you been cut off while you're overseas or will you be cut off when you return to Australia?
