I don't know off hand, I'd have to dig out my last passport which is... errr... not here. I'd say, after a good deal of thought, that I was probably in Australia waiting for my divorce and property settlement to come through. If that was so I certainly owned property in Australia at that time. Which means that I would have been a resident even by Centrelink's criteria.

At the time in question we owned it but it was rented out for some of the time we were away

to scuzzy when i asked welfare rights about grandfathering her answer was "she is not a lawyer"!

to members,i had my SSAT hearing yesterday and got my decision back today that it has been set aside,and scuzzy because i was back before the 1st july 2004 the rule changes do not apply?

This is great news, one of their decisions under the new residency rules has already failed. Centrelink will NOT be happy about this.

to scuzzy, because i was back in aust before the 1st july 2004 i DONOT have immunity from the changes, sorry mate i worded it wrong.

Reading your decision I noted that they said that only those that were overseas ON 1st July 2004 were grandfathered. One day either side and it was too bad.
