It's difficult to pin people down, like most online sources we have people wander off after they have achieved their goal or given up. The end of year newsletter usually reminds a few to drop me a note and let me know how they got on though.

How exactly does this 2hr ,2-8hr,2-15hr thing work? ? How can they assess you ,when in their own words " NO WORK CAPACITY TEST,"ARE YET TO BE DEFINED.wtf C/Lwill provide info once available. And how can they OVERIDE medical reports and evidence.LEGALLY

I think the reason behind the 6 weeks deal is they know it makes it harder for people to go back and forth, as the costs add up like more airline tickets per year...be good to win the lotto and tell them in person to shove the DSP...

uhmmm just got a document of 78 pages to me and to where I stay which no 1 knows...says the AAT sent it..bike pulled up outside and gave it to me..it's like some spy movie..last chance is 12th April..but I think they want my ballsss...chittt..the thing is if u r a citizen u r a resident...but they have changed the rules...to suit themselves..and they say they closed a LOOPHOLE..but there wasn't one..cus people applied to the law..just the usual a/holes tryn to get Aussie against Aussie...the Gov't been doin it for ages. get Gillard to give her $116,000 payrise to the poor..doubt it cus she's Whelsh.Australia is just about all the way down the plughole...c wat happens..cheers.

That was my exact uptake on citizenship/residency Bundyrum: If your not an Australian resident or citizen, then you would not have an Aussie Passport, or at least one would think? Cheetal

Citizenship is something that s the same across the board but virtually every Federal department has their own personal definition of residency. Taxation, Immigration, Centrelink...

Banjo,I take it you had no reply to your letter I did but it was a while back and not worth posting, just the standard, "don't you worry about that, DSP isn't meant to be spent overseas, look at all the good things we've done for pensioners..." Personally I like the way Gillard got rid of him and the others, they have to shit or get off the pot now... would be surprised to see the Labor Party split, the way they did with the DLP years ago.

Re citizen of Australia and thus resident --?? not so easy Centrelink use the difference between resident OF australia and resident IN Australia to persecute people with enough balls to try and get a better life Sec 7 criteria for residence IN australia 1. The frequency and duration of the person's travel outside Australia. 2. The nature of the accommodation used by the person in Australia. 3. The nature and extent of the family relationships the person has in Australia. 4. The nature and extent of the person's employment, business or financial ties in Australia. 5. The nature and extent of the person's assets located in Australia. 6. Any other matter relevant to determining whether the person intends to remain permanently in Australia.

Further to my last post residence it also used to say no one factor should be used to assess the situatioin and therefore they cannot use #1 as a sole justification I also read somewhere that if they maintain that you do not reside IN Australia the onus should be upon them to prove where you do actually reside -- given that you must reside somewhere I dont believe they could win a court challenge on this basis but has anybody had to take it all the way?

I returned to Australia last july to find I was 'no longer a resident' Cl asked me how long i was intending to stay and I said "I was away on holiday I live here permanently I am back permanently" After a bit of arguing we had a quick run through the criteria i was given my concession card ( ie residence ) If I say I am back permanetly they would find it hard to deny me residence I change my mind and I leave again after a month and the merrygo round goes on I will be back next week so it will be interesting to see if I am again 'non resident'

As far as I know if you pay tax in Australia it is a big swing in your favour as an Australian resident when it comes to centrestink's version of "residency" You can elect to pay tax from your pension & can elect the amount (last time I checked about 6 months ago. You can elect to pay $2 per f/n if you wish & of course you get it all back because we are so close to being (& technically we are, according to some reports I have seen) below the poverty line in Oz. Banjo, as I am lazy today & you are so fast with knowledge & info can you clarify or comment please Thanks, Mel
