Thanks Boss! As you know I've been outta commission so to speak of late, but I have overhauled the V12 and all cylinders are firing again; well until the next break down that is But old Barangy has really impressed me of late, and even though I haven't been posting much, you know I am a sucker for all the gossip and can't help reading! Appreciation of good effort and valued thoughts are the least we can oblige each other; or should I say: Those who truly deserve it, and not saying that you do Have a glass of Red for me when you do catch up with him for me please Boss... i think il be keeping safe and not going back to aussie that way il be sure of keeping my u/p that way knowing my luck iil get back to australia for a week and they will change the rules lol better to be safe than sorry so il be enjoying the u/p and only going back to aussie when nessecessary hopefully never lol

cl is right in that case! for all guys with UP make sure u out of the country if another rule change comes otherwise you could lose this also.

thats true tim2013 u can lose u/p if the rules change and ur in the country just say u fly into australia on dec12 and the new rules come into force jan 1 and ur still in the country when they are implemented well goodbye u/p then you have to go through the same even more stringent rules to gain u/p again uthats y i say keep safe and just dont go back unless you really have to and keep checking this forum for any rule changes thats my advice

This is the way it worked the last time the DSP portability was grandfathered in 2005, those overseas were automatically grandfathered, those not went onto the limited portability. I do believe that those who have got the IP and told Centrelink that they will live overseas will have a very good case in appealing any adverse decision.

That's my take on it Boss; C/L would open up a huge can of worms of litigation, which would only lead them into all sorts of appeals and court battles. I was waiting for you to add your two bobs worth Boss, so as to see what your take was on this subject of imagined future sanctions against "IP". Grandfathering in essence, was granted to those out of the country and with preclusions in place where they could lose that entitlement upon re-entry after overstaying, as I see it. Indefinite Portability is entirely different for those of us who have had the tenacity to apply Tim2013, and who have passed all the imposed prerequisites laid down lawfully and C/L in turn have granted our entitlements to travel freely. Unlike what you believe and preach Tim2013, C/L are certainly not stupid and that's why the imposed these somewhat penal system requirements, otherwise everybody and including Nay-Sayers such as yourself would apply for the hell of it and clog the system. So Team, just enjoy the luxury that you have been entitled and after all the worry associated, why worry about something that is highly unlikely anyway! So as for you Tim2013, why don't you at least apply for it and then you will have something of value to offer to those of us who already had the balls to apply for it and win? My take on you brother, is that you know in your heart that you won't pass the JCA, and therefore try to detract from the pleasure we that have it are entitled to free of worry! Therefore; enjoy your next 6 week trip brother Over and Out PS... Just think about Team, because we now have "IP", it doesn't mean we can't ever return to Australia again does it? Just imagine what a furore that would create, and especially after the bullshit C/L put us through to obtain it! Cheers and Enjoy Team....

My take is those on the IP will remain residents in Centrelinks eyes, you can return to Aus for 12 months and still leave on the IP again. This is the difference from grandfathering. You WILL lose your Medicare card after 5 years though and it may be hard to get back if you come back then intend leaving again.... Different residency rules. Once again, purely my opinion.

Immigration law is different, I have posted about this before if you would care to check this forum, or you can do what I did and phone Immigration. I could put a few more lines on this post but then that might offend you.
