Smart doesn't come into it, if he loves her and wants to marry her then that's the end of it. The consequences are well documented here.

OK. this is an important thread that was set up to specifically discuss AWLR and that's all it's going to do. All further off topic posts will be deleted.

I would appreciate just checking my understanding of the working life residency change.
I understand that if I have been a resident in Australia for 35 years at least since the age of 16 then I comply with full residency requirements to be eligible?

Yes, you don't have to have actually worked, just have been in the country. There was a some discussion the other day with a member who had worked overseas for several years as to whether that would affect his AWLR.

Thanks BanjoYeah... I appreciate for some people that it could be problematic about working life history.... But anyone that's not as old as Banjo... just remember that your pension age now increases depending on your year of birth... if that makes sense...

Anyone who travels or lives overseas who is receiving the DSP under the Unlimited Portability is NOT subject to the AWLR ( Aust working life residency) rules :-
UNLESS the disability occurred while they were not an Aust resident.

See below for copy of legislation regarding AWLR and DSP under UP
Division 3—Rate of portable pensions
1220B Proportionality—disability support pension rate for a severely disabled person
(1) The rate of disability support pension for a person for whom an unlimited maximum portability period for the pension has been determined under section 1218AAA or 1218AA is to be calculated using the Pension Portability Rate Calculator at the end of section 1221 if: (a) the person has been continuously absent from Australia, throughout a period (the period of absence) of more than 26 weeks; and (b) either: (i) immediately before the period of absence commenced, the person was receiving the disability support pension; or (ii) during the period of absence, the person’s claim for the disability support pension is granted under the Social Security (Administration) Act 1999.
(2) Subsection (1) does not apply to a person if the person became qualified to receive the disability support pension because the person became unable to work or permanently blind while the person was an Australian resident.

So... If you are on DSP now and near OAP, but will have less than 35 years AWLR after Jan next year, you might be better off applying for Unlimited Portability than Age Pension.
Assuming you think you will qualify as severely disabled.
Depends upon how close you are to having full AWLR. I reckon OAP is a safer bet than DSP with UP.

I'm having difficulty understanding, If I'm on DSP with u/p granted this year will my payments be reduced under AWLR after 6 months o/s ? If I worked o/s for 5 years will that mean I will have to wait an extra 5 years ?
Thanks Dan

I'm not sure how that works, if your disability happened in Australia I think you would be OK.
Wait an extra 5 years for what?

Thanks Banjo Yes my disability occurred in Australia. In my 20s I worked & lived outside Australia for nearly 6 years, so I was wondering if I would have to add those years to my AWLR ?
