Meaning of terms used in this Part
"eligible medical treatment " , in relation to a person, means medical treatment of a kind that is not available to the person in Australia.
What if unavailable by cost???
11 May 2015 2pm no call reciept number. Speaking to 2 in the overseas payment division.
I left a recorded query they were so late replying to that a review officer apologised, he then tried to connect me directly but said it had been having disconnection problems lately. I was connected to a person who asked which department I wanted. When he connected me it disconnected. Then the review officer (think police of the police) ensured I got a qualified person. This person told me unavailable by cost was a “no go area” and passed me up to another.

At first she said the month overseas was concurrent with the month holiday . It could be extended 2 or 3 weeks for family crisis [acute family crisis up to 1 month]. She said she was a professional [in the overseas payment division].
She said its for ground breaking treatments etc only and not interpretable.
When I asked her the act reference she did not give it. Saying it was clear.
she did not quote “not available to the person in Australia.”
Clearly she was wrong. I said not available because of cost and she said that it is still available.
I know how bureacratic internal pressure works so “no go” immediately says political toadying by appointed croneys. Administrators know the will of the minister. But… the minister may have created the legislation before thinking about this. So too late now for them to change their minds, that is illegal.
Anyway she said I can’t get a decision to challenge this until after I had used up my months travel and then applied. Then I can start the appeal process and then take it to administrative appeals.
