I should finally get a decision on my dsp restart very soon, then, if successful, I intend to apply for I.P. I'm physically and emotionally drained, I've been living on the smell of an oily rag just to keep the family OS healthy. After studying the assessment tables, and putting them onto paper, I really think my health probs are sufficient to succeed, but we all know things dont always work like that. Can anyone offer some advice or any tips which may help, thanx

Have any of you members had any success appealling the ' non permanant residency ' issue to enable you to apply for ' portability '? If so, do you have any advice

What do you mean, the "non-permanent residency" issue?
Are you a citizen or a permanent resident?

I recall I was on repeated medical certificates for serious injuries and another on going health drama. The certificates exempted me from applying for jobs. At some point I ended up on sickness benefit, then after a while centrelink wanted me to go onto DSP. I refused DSP and came to an arrangement where I could try to rebuild my old business, because although I could not be employed, I felt I might be able to be self employed enough to make a new job for myself. Reason for the story is that if you're on repeated medical certificates and your doctor is certain you cannot work, it might make sense to apply for sickness benefot rather than newstart. And maybe (maybe) that will be a stepping stone back to the DSP. I'm guessing here though. Might be worth talking to someone older and wiser. Cheers, As far as I know, Sickness Benefit or whatever they call it these days is only for people who have a job being held open for them to go back to, or some established job that they were doing before that they will go back to. Otherwise it's "Newstart Incapacitated" (or whatever that is called these days), which is Newstart with continuing medical certificates. That's what it was like a while ago; someone correct me if things have changed recently.

I was stuck in Phil, for 12 months ,DSP was cancelled . Centrelink would not believe Doctors in Phil. Got back to Australia October 2015 , immediately applied for DSP. Put onto Newstart with Medical Cert from GP. Had JCA in December , had to see DMA in March I'm still waiting for an answer .....6 months And I have been on DSP , on and off since 1989. I'm just trying to get back to my wife , trying for Indefinite Portability , been knocked back on that before , cause even I have 20 points , JCA says I can do 8 hours work per week . They don't tell you who will hire you with the conditions you have though . Its really tough now just trying to get back on DSP , let alone Indefinite Portability . Very hard for me and my wife .

By the way , I have been contacted Basic Rights again in QLD they have been really good in the past , and they just said that's the way it is now since the new rules were made in July 2015 , when I was stuck overseas , because of medical conditions ,Basic Rights said I have to just wait .

You may need to consider a "plan B" and start work on bringing your wife to Australia.

I want to live in Philippines, cheaper cost of living , and the cost of bringing my wife to Australia , is too high ,
if successful. I have faith and I will just wait it out .
I just wanted all to know how long all this DSP restart / reapplying takes.

Problem is there will always be those that don't quite meet the requirements for indefinite portability yet are too disabled to get work.
This is so unfortunate and I don't really know what they can do. Annoy the hell out of your local MP on a daily basis might be a start.

Ever since it came in I've insisted that "no future work capacity" should depend on more than points on a disability table. Insisting that portability should depend on only one impairment is ridiculously unfair as well.

By the way , i received TPD, and having hard time being reinstated DSP. My GP , said there was different criteria , for TPD , and DSP Indefinite Portability .
Well , TPD means thats it , no more work , even my Clinical Psychologist stated the same , and couldnt understand why i can get TPD , and not DSP Indefinite Portability

That is C/link have different criteria , than the insurance for TPD
