I vaguely remember ages ago some people on the forum saying they were separated from their families and hadn't seen their kids in months/years because they weren't on unlimited portabilty on DSP. Is there anyone out there who this still applies to?

For those who have recently joined the forum, The government started enforcing their version of the residency rules on traveling overseas a few years back. Many people had been allowed to live outside Australia and maintain the DSP by returning twice and later four times a year. They had set up homes and families and all of the sudden the rug was pulled out from under them. Many were forced to return to Australia and placed in the dreadful position of having to keep themselves in an expensive society while trying to support wives and children overseas.
This injustice was the foundation of our forum.

I've seen my lot for 26 days per year, two days being for travelling, since 1st January 2015 when the new rules came into effect. The last two years have seemed longer than the previous decade.
I did apply for UP in late 2014 but like so many others withdrew my application because of rapidly failing health due to the stress of possibly losing my DSP and therefore no longer being able to meet my commitments, either here in Oz or overseas.
Unfortunately I'll turn sixty five, three weeks after the new OAP rules come into effect on 1st July this year (2017) and then have to wait till January 2018, the way things are feeling right now the next eight months are shaping up to seem longer than the last two years.
Fortunately we are in daily contact via video call and because my outlays are minimal, utilities, rego and food the money has been going around ok. In the right circumstances it is possible to live on a Thai budget in Oz and save for yearly fares as well.
Lack of cohesive parenting is a big drawback in this situation, though with a large stand of bamboo out the back and instructions to cut a switch upon my long term return, the thought of that switch should eliminate the negative behaviours that have arisen.

I still regret not appealing my UP knock back in 2012 but the ARO put me off for 6 months (surely a record) by which time I was on the home run for the Age Pension. My appeal was going to based on "no future work capacity" which I would claim that age, length of time out of the work force and other issues should have as much bearing as the impairment tables.

The double whammy was that the government brought the 4 weeks a year rule in about the same time as a massive increase in visa fees making it practically impossible for a pensioner to bring spouses over.

My only real supports are living overseas in a reciprocal country in europe. I returned today after 4 weeks there. Crying.all the way back on the plane for nearly 27 hours. Panic attacks major depression suicidal thoughts just feeling like giving up. (But i won't do that just feel so desperate at the moment.I live with my mum here in Australia while waiting for housing(been on catorgy 1 now for 3 years) my mum is very toxic and is a big part of the cause and has has worsen my mental health problems. It was my psychiatrist who told me to take a break go overseas and spend the 4 weeks allowed with my very close supportive loving family. Every year When im living with them my health improves. Then i come home and i spiral down a dark path needing.to re adjust to Australia and no emotional or caring support system My husband is finally agreeing to apply for a spouse visa so he can be my support here in.australa.Im going to apply for up will ring tomorrow for paper work. Can someone please explain the process. I was granted dsp in early 2015 al in 1 table. 0-8 hours but after 2 years of intervention they say it will increase. I have not recieved or been refered to any disability employment services i see a private psychiatrist every 2vweeks and psychologist once every month.They both especially the psycharist urges me to go overseas and said he will fully support me going there until i get my public housing and my husband is allowed into australia. Thankyou. Sorry about the long post hopefull...... From what you say in your post, the frequency of your visits and the support of your mental health professionals should be a big help in your UP application. After submitting your application you will be required to undergo another JCA, but most importantly before submitting it make sure you have current up to date medical reports to submit with it. Basically to get UP you need 20 point under one table, which you would appear to have and a JCA that gives you 0-2 hrs work capacity, although some people seem to have been successful with 0-8 hrs. and the condition must be fully diagnosed, treated and stabilized and be ongoing for 5 years. Hi Nomadic, yes me, ive been away from my wife and son going on six years now, ive missed 4 birthdays and missed his first day of school and just recently his first day of big school, had a portability assessment on August 1 st, with a occupational therapist, then i just got a letter the other day saying they want to do it again, i believe this is highly unfair, she said she does her assessment then it goes back to c/link but obviously they can just change the rules as they go along....so whats new..!!!!!!!
