Well just got a email Friday, been knocked back. Have more letters than god that i have problems. Getting legal advice now, but 30 points to 5 i think the ssat is on c/l side. I will try and attach the letter for people to see what is goindag on. jimmy55x that's no good mate. Don't make any fast moves! In your position I would re engage with my Medical team regularly. They have dismissed the agoraphobia because of your travel. Concentrate on your Anxiety/Depression and Spinal injuries. Both of these conditions require regular medication and visits to your professionals consistently. You will need all the ducks in a row for the High Court. All the best mate, bear

I regularly attend the doctor and the psychologist, on a monthly basis. I am close to giving up now

One issue I think they are using here is the change in diagnosis of your mental health Jimmy... the letter from the clinical psychologist was outside of the 13 week 'window'... I'm not sure if UP is the same as DSP but can you reapply while you consider things? I don't know if it would help but I have seen a number of people get through by continuing to apply so that their medical reports fall within the 13 weeks.

Well this is the latest, i lost at the AAT. But it took 7 months to make decision, Then yesterday i was sent a bill for $21545.29. Legal rights Queensland is on it, but i fear that when it gets hard they give up. I cant get anymore money from my family to fund private legal. I wonder how many people are being thrown off? A nice girl at C/L yesterday was very helpfull [she must be new] and said she was sorry to hear my problems. Does not help much but

I may be repeating myself jimmy but you need to call the law institute in your capital and ask for referrals to law firms who specialize in centrelink law and who work pro bono. They will give you free time to tell your story and assist you for free if they think you are right. PILCH is another group who work for free also (Public Interest Legal Clearing House). although they may have changed their name but any law firm on the high street should be able to give you their details.

I really hope you get this all sorted out soon Jimmy, preferably in your favour.
How can they ask for such big amounts of money from people they know are not in a position to pay? Seems criminal to me.

The bill is because i was getting DSP while they made up there mind.And yes legal rights Queensland is on it, they are calling tomorrow. Mean time i am starting a new application. I have a new dr and he is very helpfull. I have new letters from him and psychologist.C/l has put the debt on hold pending ARO. We all know how this will end

Too many questions from me so will just wait to hear how this madness unfolds. $21,0000 bill for being paid DSP? Madness that is not possible for you to repay i can only think. Another case that will eventually be either an episode of a real life soap opera or a horror movie.

This is a real Centrelink horror story. On one level it is warning against anyone attempting to get UP unless they have 20 points on one table. In the current climate it seems much more likely centrelink will downgrade rather than increase a person's points rating on any one table. I can't see how they can use overseas travel as evidence of functionality, anyone can make it onto an airplane. Being able to travel from A to B whether by air, sea or land has nothing to do with being able to hold down a job. To me it seems unlikely that you will get portability but if you persist i feel there is a chance that you will get your DSP back. If you get your DSP reinstated then you can argue to have that debt wiped. They assessed you in 2014 as having 10 points in spinal and 10 points for mental health. If your conditions have not improved you should argue that that assessment is still valid.

Mulloway, i had 20 points in mental issues and 10 for my spine, on applying for up [to see my extended family] they dropped me to five points for my back. I am back on new start with medical cert. That they all most didn't take as well. And Nomadic it is a horror film only real. I think at $20 a fort night it will take about 20 years to pay, i will die before that i think. So i will probably win in the long run

Just a couple of things which welfare rights may already have covered... Was the assessment done in 2014 against the New tables? When was the UP assessment completed? Was the mental health diagnosis by a clinical psychologist?
It doesn't seem possible that Clink have done their calculations correctly... they can only raise a debt for the difference between Newstart and DSP for the period since the 5 point assessment was done... approx $100 A week difference I think for single rate? I wonder if they have done what they did with us and claimed the full amount rather than the difference?

So i will probably win in the long run jimmy55x Not sure how this may affect your circumstances but if I was in your situation facing a $20,000 debt to C/Link I would go back to them and say I will declare myself "bankrupt" and you (C/Link) need to fix this up. As far as I know but it is my understanding that if you are "bankrupt" and on the 'dole' they cannot take money from you. Maybe a $1 per fortnight.
