Well I just payed a clinical psychologist for a new report. He says on a letter that I am completely unfit for work and that I fall well within the 20 points. Now that will be 4 letters for that and 3 special reports on my spine. That should fix centrelink right up you would think?

Well just got off the phone from welfare rights very helpful. They are representing me tomorrow at the SSAT. This is my armament, Definite have 10 points on spine treated documented done. I have to get my depression anxiety from 10 points to the 20. Have doctor report saying treated since 2008 on various drugs. 3 psychiatrist confirming this, one with a lengthy report addressing my disorder in point form. Matching table 5 under 20 points. Also confirming 16 months treatment. Another clinical psychology report from an independent I payed for a 3 page report saying I fall into the 20 point category. And last but not least a specialist report on my liver with function tests saying I have cirrhosis of the liver and fall in table five of the pugh test. Meaning 50% chance of living 10 years. I am 45 now by the way. C/L have never acknowledged this part and hope for another 10 there. But I ask with letters saying 20 points how can I get knocked back? Have not worked for 8 years, same doctor same drugs.5 doctors all up saying exactly the same thing. What do you all think? I am super anxious about this. THOUGHTS? ?

We can only wish you luck Jimmy, I found the SSAT to be fair and reasonable in my personal case but others claim a different experience. Just state your case truthfully and reasonably, that's all you can do now.

I am super anxious about this. THOUGHTS? ? G'day jimmy55xI think it only natural that you should be feeling anxious but you have got all the documentation so they are going to have to come up with some 'bloody' good reasons to knock you back. As Banjo says above we wish you all the very best.

Well just got the letter in the mail...KNOCKED BACK. She at the SSAT agrees with the original decision of 10 points spine 10 points anxiety. Rang welfare rights she says a AAT appeal wouldn't go far. Best start from the start, with a new claim. I don't understand this, nothing has changed for years. Been going every month to the physiologist independent report written that I have 20 points. So my question is if I start from scratch again does it just look like I am a try hard? Or do I go to AAT anyway? Just spoke to a friend who works with the disabled. He says some of his people are alcoholics that have all made claims for DSP of late. Everyone denied, coincidence I think not.

That's a strange decision Jimmy. I think blahblahblah has a good suggestion, the AAT will cost you nothing so why not put in appeal now?

Sorry news Jimmy. Go to AAT but try and get legal help as that is your best bet. Expert lawyers know all the laws we mugs dont. As I have advised many times, call the law institute in your capital (tell them exactly what your situation is), who will give you a list of lawyers who specialise in social security law and do pro bono work (for free) and will at least give you a thirty minute hearing for you to tell them your story. If they think you have a case they will work for you for free. If the first one doesn't take on your case ring the next and the next until you run out or someone takes you on. What state are you in? I'm off line for a few days but will check again next week if I can suggest some other things. Just don't give up because that's the game they play. they try to wear you down so don't let them.

Thanks for that everyone. OK i will do both. But it puts super pressure on me. You know nomadic i almost did give up when the mail arrived this morning. But reading this i will give it a go. I wonder how many make it at the AAT?

Let's look at it this way... what else are you going to be doing with your time? This is the AAT recent decisions site. www.aat.gov.au/AATDecisions/ThisWeek.htm#socialand also here. www.austlii.edu.au/au/cases/cth/aat/It's not easy reading but you will be able to see how poorly prepared some of the appellants are. You need to get sympathetic reports, the ones you mention earlier that said you had 20 points, see those people again and get them upgraded.

Thanks Banjo, Just been reading your links. You are right not easy reading. I have read about 50 cases now, only 1 good out come. Some bloke with Bi Polar/ scitz. This brings me to my question, what exactly donates a program of support? I was told by welfare rights that I should keep with my DES, but I am exempt. And they already have taken me off the system. I have doctors certificates exempting me from all work. This is the part they are getting me on. If I can't leave home, how can I have a program? Does a program include medication? Does going to my psychologists count? He is commonwealth funded 100%. I am confused again

Program of Support for Disability Support Pension has changed
Monday 09 February 2015
A Program of Support helps you prepare for, find or maintain work. Program of Support providers will usually develop a plan with you, taking your level of impairment into consideration.
From 5 January 2015, as part of the 2014-15 Federal Budget, only Commonwealth Government funded programs can be a Program of Support. These include:
Disability Employment Services Job Services Australia Remote Jobs and Communities Program, and Australian Disability Enterprises
Programs not funded by the Commonwealth may only be taken into account if you commenced the program before 5 January 2015.
Program of Support for Disability Support Pension
A Program of Support is a Commonwealth Government funded program to help you prepare for, find or maintain work.
Programs of Support include:
Disability Employment Services Job Services Australia Remote Jobs and Communities Program, and Australian Disability Enterprises
Providers will work with you to develop a program, tailored to your level of impairment, to address any needs and barriers to employment you may have. The provider will connect you to vocational, rehabilitation and employment services that have a particular focus on developing the skills you need to improve your capacity to find and keep a job.
Working in Australian Disability Enterprises is also considered to be participation in a Program of Support. Australian Disability Enterprises provide a wide range of supported employment opportunities for people with moderate to severe disability.
Programs not funded by the Commonwealth Government may also be taken into account if you commenced the program before 5 January 2015.
If you are claiming Disability Support Pension we may ask you to demonstrate that, over the previous 3 years, you have:
completed a Program of Support, or actively participated in a Program of Support for at least 18 months
If you are currently receiving Disability Support Pension, depending on your circumstances, we may ask you to:
have a comprehensive medical review, and actively participate in, or complete, a Program of Support within a 3 year period

Not sure if that's any use, maybe best to stick with what Welfare Rights suggest.
