I agree with you Banjo, but this fact is from my personal experience and it is 100% correct. Otherwise I wouldn't be able to visit my family this year.Last year I left AU on 4/7(returned early Sept.) and this year I left on 5/7 and also returned early Sept.My DSP was automatically reinstalled, the moment I passed Custom control.I immediately called C/I to let them know that I am back, although they told me there is no need for that."Better safe than sorry"!

All well and good . But I can't say , oh , the guy on a forum says your wrong ,๐๐๐,,, Centrelink International . I need more than that ,, Best wait to see what the Minister says to Banjo,,, if it's different to the Folk at International, at least I'll have some credible back up. I'll have something they can't argue with . I can take it from there . It's too risky otherwise. Cheers

An update .
I've rung again ,, held on for over an hour ,, Once I got a human ,, re asked the question. Same answer. I kept saying , are you sure ,, because yada yada,, I spent 45 mins talking to her , ( dam forget to get a call number ) She went above, asked other people ,, It's a rolling year ,, she said . Re starts from when I return , because I take the whole 38 days at once . Because it can't be calculated from the beginning ,, because I'm not in the country . So it's not once every 365 days if I'm not here for the last 28. It's a " rolling year",, was what she kept calling it . Yes,, if I take it at once ,, it does mean 13 months , from when I left. Yes,, people will miss Xmas with relatives, yes I will miss hiding from winter ,, yada yada.
There ya go.
( still interested in what the minister says )
But I'm not happy .

A rolling year just means a 365 day period with a start date other than the calendar year 1 January. We are allowed 28 days out of 365 away. So, here for 337 days + away 28 = 365. To start the count for the reset date, one must include the 28 days away in order to reach the 365 day total. It's basic maths.To count 365 days from the day you return means 365 days with no travel - that's not the rule.
Other members here have received reset dates which are the anniversary of their having left.
It sounds like International staff have done some new training course on the 28 day allowance and been trained incorrectly.

I can only repeat,, if I call Centrelink International,, and they tell me differently,, It is Centrelink International,, who have the magic pen , that will stop my payments. All very well you guys saying it's from the beginning,, which I agree,, BUT,,, they are the ones with the power. I cannot say , the bloke on a forum,, says your wrong ,, Up and untill ,, Centrelink International give a different answer,, I'll wait . I'm scared as it is something will trigger too much attention,, I'm not up for a fight ,, I'll quietly wait for it in writing from the Minister ,, I will email the address you've put . Cheers

Nocraptalk, it's completely reasonable to want it from International - that's why I suggested calling them. It's a shame they're not making much sense.
My post was by way of explanation of what I consider the logical calculation.
Bear in mind you can overstay 28 days by another 13 weeks, but you won't be paid beyond the 28. Probably not much help unless you have savings...not like we can eat air. Edit: contacting Welfare Rights is always a good plan. They know this stuff too.

We cannot advise anyone to do this, regardless of what anyone claiming commonsense says on a forum, she needs something solid from Centrelink and or the minister. I've had a lot of help from Welfare Rights over the years but I've never found them over enthusiastic when it comes to portability and have gone against their advice several times without repercussions.

[/quote] I have had help from basic rights , and have an AAT hearing February 2016, Basic Rights at first said they would represent me , but now they wont . Hearing is for Indefinite Portability refusal by Clink.

AAT hearing Feb 2017 Basic Rights say I wont succeed, But I have to kerp trying. Haven't seen my wife in Philippines for over 1 year.
