AAT hearing Feb 2017 Basic Rights say I wont succeed, But I have to kerp trying. Haven't seen my wife in Philippines for over 1 year. I know how you feel mate for I've been that soldier also

Murphy, well done. Finally somebody with common sense. That's what I am talking about all the time(been there, done that). Just one more time I am going to repeat: The anniversary date is the date when you LEFT the country!Volonteers who work at the Welfare Rights Centre are qualified(layers,paralegals...) and have access to all the informations regarding this and other matters in dealing with Centrelink. Ask them, it will save you plenty of time(and nerves): Volunteer@wrcsa.org.au Good luck! I don't know if your implying, I have no common sense ? I can only repeat,, if I call Centrelink International,, and they tell me differently,, It is Centrelink International,, who have the magic pen , that will stop my payments. All very well you guys saying it's from the beginning,, which I agree,, BUT,,, they are the ones with the power. I cannot say , the bloke on a forum,, says your wrong ,, Up and untill ,, Centrelink International give a different answer,, I'll wait . I'm scared as it is something will trigger too much attention,, I'm not up for a fight ,, I'll quietly wait for it in writing from the Minister ,, I will email the address you've put . Cheers I am not implying anything, I am just telling you that Murphy is right. Even if you succeed in getting answer from C/I, it won't be in written form. Trust me ,I tried many times! The Welfare Rights are at the moment our only hope and I can't praise them enough for all the help and support regarding my dealings with Centrelink. Here is the answer I got from them when asked the same question that you have: "The 12 month period begins when the person goes overseas. If you go overseas on 1/7/2015 your next period should begin on 1/7/2016. It is a rolling 12 month period so when a person goes overseas for the first time after 1/1/2015 that date will always be the start of their 12 month period." I hope this helps!

Re when the revolving year is counted from .
I rang Paul Herweynen ,, ( Thankyou Banjo for his number ) I must say , he was really confused too. It did take some chatter ,, to get across what I needed to know for sure .
I did expect a big wig to be a tad more informed .
In the end ,, is counted from the day I've returned last,, ( in my case seeing u take the whole 28 days at once .
Counting the day you leave and the day you get back .
I had one day left over from last year , but as much as I tried , I was unable to get him to understand , how I could tack that day on to this time , if I went a day before the 365 days , it should tack on ? But he just didn't get it ,, just didn't . I gave up.
I also explained I'd rung three times and got the wrong answer ,, could he look at my record , follow up who I spoke to,, and possibly restrain them , 3 different people giving out wrong imfo. As he looked at my records ,, said there was no record of my even calling ,, ( well that's dumb but I didn't say that ) I asked him to please ,, write on my records ,, this call,, please show it ,, that I have rung ,, HE had given me the ok , and all is good in the hood .
I'm going to risk another phone call,, I want to collect that day I missed last year,, as they don't roll over , but if I go in the edge of both years ,, technically I should be able to pick it up. A day is a day,, after all.
