chaks if you're close to a local Centrelink office drop by asap and ask for a copy of you IP application JCA. It was my slip up failing to mention that in my previous post. Sorry about that!! It may help with answers to any questions they ask. Perhaps it's cutting it short but it will definitely be a help for another attempt; as will your file, which is obtained through FOI. just my opinion but it seems that when you appeal any legal decision you need to show new legal evidence or at least show they missed part of the previous ones. Maybe try to go to a legal aid office for advice. The Melbourne office I went into had an expert lawyer in the field who gave me the facts I needed to eventually win my case.

If at all possible, definitely get a copy of the IP JCA (and if possible the JCA from your DSP claim) before the call. As with bear, any response would be a guess in terms of what they may be calling to ask about, I can only recall receiving a letter when my DSP claim(s) were rejected. I was asked if i wished to appeal through the AAT (which I did), so it may be worth considering ahead of time how far you wish to take this application. One question it is probably worth asking would be whether you can have an IP application under review/appeal with the AAT at the same time as a new application (you can with DSP but I have recently found out you cant with NDIS). If you can appeal and have a new application without 'penalty' you may as well do both and put in your best possible new application. Just remember the receipt number when you speak to them

Hi all, Just an update, unfortunately I was rejected as many of you predicted. I did appeal and within the next 2 days someone will call me asking why I believe the decision was wrong. I have also sent them a letter of support for Indefinite Portability payment from my psychiatrist for more medical evidence. What will I be asked and recommend to say? Thanks. it is almost imposable to get indefinite portability for mental health. they always look at the physical only for the job capacity Assessment .

I got I/P for mental health in 2021 was 37 years old so it’s definitely achievable. Took 6 weeks from phone call to Centrelink international to send out the paperwork until approval. It was a quick turn around I believe it was due to Covid and not so many people trying for I/P at that time. Left for Thailand 02 July 2021 best decision ever.
The lady who advised me on I/P application from Centrelink said they asses them on departure date so the sooner you say you’re leaving the quicker they will asses you she said. But allow enough time to be assessed
Don’t know if that’s true or not just what I was informed.

My U/P was approved for mental health aswel. Best thing since sliced bread.

What you'll be asked is a question I wouldn't presume to be able to answer chaks. What I'd recommend to say is; be truthful, as by doing that there's less likelihood of getting tripped up later. I cannot recall an appeal being handled in this way before. Perhaps it's a Customer Service Officer (CSO) review. If so it's likely to be denied, as the majority of them are. If so there are two options; a new application or through the AAT. But let's put those aside for now. You've already done the experiment and know your mental health is much better when you're overseas and your psychiatrist agrees with you. Remember to ask for that receipt number and in cases such as this, the call may come in as 'private number'; so answer your calls if you're prone not to. Cheers 🐻 Something else to remember (that I completely forgot before) - you can have both an appeal and a new application in at the same time.
