I THINK so....you will have to phone them and start the process, then they will call you some time in the next 6 weeks (or so). How will they do that if you are walking the streets with no mobile phone ? And how do you propose to feed and house yourself in Thailand ? Better to phone them and ask for payment pending appeal, then take it from there. You're much better off broke here, than broke there. Try church groups etc for accomodation.
There's a guy in Centrelink International who is a reasonable fellow. I'll send you his name via private message on this forum (look at "notifications", above). We're not supposed to mention real names here.

to fredb,i think going back and trying to appeal from o/s would be hard? trying to ring them from o/s could be awkward,i.e ringing them and i am sure they would throw it back in your face that u left again? i cant tell you to do this or that but if i was in your position i would go in and appeal it on tuesday and apply for payment pending appeal ,once this is sorted and you are reinstated??( it is your right to apply for payment pending appeal). once and if you get payment pending an the appeal process is started mayb then you could leave again?? when u talk to them tell them u have cancelled your ticket and you would like to appeal their decision on the fact they made their decision on a future action? i have had this happen to me where they made a future decision on a future action?? i hope this helps mate,all is not lost yet buddy!

Make sure that they know you are appealing, you may wait hours on the phone ringing from Thailand. Insist on being paid while waiting for a review. You need to email Centrelink at the least, with a phone number they can contact you on. Also email Welfare Rights on the contacts I gave you. Remember when you tell Centrelink that everything you have in Thailand you make their residency case for them. Start thinking about what you have in Australia. Because they consider that they have acted properly under the legislation and it is now his responsibility to solve any dilemma he may have put himself into. That is the way they think. They say guilty, he has to prove his innocence. He needs to see what ever letter they have sent out and take it from there. Hey Banjo, I am merely trying to find out how to help the person, in the best possible way. And that is the basis of ALL my questions and comments on this forum. As you and anotherdsp and hypoman and zorro1 and latindancer and probably others are saying, there are alternatives so NO I do not understand the problem. So, and I ask again, what is happening? ??

It sounds like he has done too many back-to-back runs to Thailand, so Centrelink have decided to deem him as being non-resident in Oz. If he wants to get his pension reinstated, he'll probably have to return here for a certain time before he goes back for the allotted period we are currently allowed.
He MAY be able to get payment pending appeal, if he speaks to the right (sympathetic) person. Or if he has compelling reasons to be in Thailand (health, either physical or mental). After all, it IS Winter here now.

I go back and forth all the time I only stay 1 or 2 weeks and go back again. and the girl i spoke to last week knew this , when she told me about the new rules in 01/01/2015 so I buy a return ticket here and a new return ticket in thailand and yes it is winter here and they know i stay longer in Thailand in winter and less in summer they know i have cancer and every one i have spoken to understands anyway hope the house will sell soon and I will get my retirement visa , If I live long enough i will come back for the old age pension

how long over 42 days did you stay if you were not long over you maybe could get a doctor to write you a letter to say you were to sick to travel just a thought

You're fortunate to have something to fall back on but I can assure that relying on Centrelink's understanding and good nature is not a reliable plan for the future.
We have a member here who was involved in animal rescue, adopted a street kid and was commended by the Australian Government for her work in the aftermath of the Bali bombings and Centrelink trashed her like a piece of garbage.

I have been over by 2-3 days a few times now I just phone and say I was sick it has been my fault 2 times as i said I return on the wrong date the plane felt on the date i told them but with a stop over it makes it 2 or 3 days late I have once send them i copy of my passport as they send me a form to be filled out but always never a problem and I am always polite to them and understand they are very busy ect ect.

I'm sorry, I thought you meant people could be paid for overstaying if they provided a doctors certificate. While it is possible under the Act, I've never heard of Centrelink continuing payments once the return date is past regardless of the circumstances.
A short over stay (up to 13 weeks) has been possible without loss of pension involving reapplying on return. Our information to date is that no overstay will be allowed next year.

Oh! Forgot to mention - When in Cl on Friday, the manager (Redfern) go back and back and bring documentation before 4-30 ! ! It was 3-30. That meant catch a train back to the city and back again. Impossible. When I asked about UP, he said "No, we are moving away from the old system"

FredB,you must be in Australia to appeal, as requested by other members, how long have you been absent o/s and how many times, did you adhere to the 6 week rule?
