I have another thought bubble ..If they change the pension rules I want a refund of my taxes I paid as a young man for my pension they so easily forgot. You mean you begrudge the politicians all those overseas trips and private helicopter flights at your expense? Come on now man, it's not as if the money was wasted.

Our member Bruce Bickerstaff has been kind enough to post the letter on his blog. www.burning-bison.com/blog/Also a message from a member who appealed the 2 year wait and claims Centrelink withdrew at AAT level. He used this argument. Portability restrictions were originally brought in because of the Italian and Greek immigrants who came here in the 1950's. They worked for a couple of years and then went home . Later they came back and claimed the pension and returned home again. They were not meant to affect rigidig Australians. I pointed this out to the Centrelink lawyer who rang me just before the AAT hearing was about to commence. His reaction was to agree with me and he restored my pension.
Appeal, appeal, appeal. Banjo, can one appeal the two-year rule? According to CL today it is legislation, so appeals won't ever succeed.

johnmac, i have been screaming this out for years. CENTRELINK ARE LIARS! Do not take anything they say as the truth. They are 99% bluff to get rid of you only. So my advice is to appeal anything and everything you don't like or agree with as it's the only way to find out the truth apart from speaking to neutral legal experts. Give legal aid a call at least about the fact they refuse to give you things in writing. Welfare rights perhaps also.

My problem with the Old Age Pension legislation is that residency is not defined in hard and fast terms much like the requirements for DSP residency never were. My issue with Centrelink is that, as many people are doing these days, someone who works 40 years in Australia, pays his tax, then retires a few years early and heads overseas for 2 or 3 years finds out his age pension is not portable when he returns to apply. His mate, who is the same age and also retired early but stayed home until 65 can then leave the country for as long as he likes. I can see the point to a certain degree for people who lived and worked outside of Australia for decades, but I believe that anyone with 35 years AWLR should never lose their residency and be entitled to full portability. People with less than 35 years AWLR are already penalised if they live overseas because their payment is reduced accordingly. Centrelink should be challenged on what is THEIR definition of residency, not the legislation.

None, we have contacts in Canberra who have heard nothing about portability or residency changes. I think that they're pretty satisfied with the damage already done.
