"The people that make this type of decision are NOT employees of Centrelink which is why Centrelink, Dept of Employment or the DES provider can't change you back to my original stream". The people that make these decisions (the granting of DSP/What Employment Stream you are on/What Mutual Obligations you have etc etc etc) are a part of "Assessment Services" and all of these decisions/implementations are now outsourced to a government contracted private provider contracted by the Department of Human Services (Assessment Services and Smart Centres Coordination – Robert Williams, National Manager) . "I have emailed them (the outside contractor) with all the relevant information and questions and if you don't hear anything in 2 weeks, give us a call back". I think the whole 'thing' is worse than can be imagined.

So I received my JCA and GCD reports back through the FOI application.
Funny how they have the power to over-ride an AAT decision on my impairment points (luckily I still had enough to qualify for DSP).
I have decided not to poke the bear (no not you Bear - the Human Services Bear:P). If and when I'm reviewed, I'll bring it up then.

Oh yeah I forgot to say. I received a letter saying my Pension Card was cancelled as of 20 November 2016. I rang Centrelink and asked them if it really was cancelled. They said No so I asked if they could issue me one that had DSP on it not NS so when I asked for my travel card through Transperth it wouldn't be knocked back. They sent me a confirmation letter saying my concession card is current. But no new card. I wonder if they will bother sending me a new card when the old "cancelled" NS card expires?

sorry krystal but i'm either confused or out of touch. are you now on dsp confirmed? if so your health care card should have dsp on it as has mine always had.

And here we go again !! So here is the current situation. Yes - I am on DSP Yes - Now that my old Pension Card (NS) has expired they sent me a new one with DSP on it. No - Nobody wants anything to do with getting me back on the ESS stream of DES downgraded to DMS when DSP was approved (apparently I need a whole less support on DSP than I did on NS). But here's the thing. The DES Program of Support I am on is the same one I have been on during this entire fiasco (the stream change doesn't affect the time spent on a particular POS) even though because of the change, I've had to change providers and start again. Centrelink POS rules are that after you've been on a POS for 102 weeks, you are automatically exited from the Program and you have to undergo a new Esat/JCA. So in 3 weeks, I will be exited from the POS that (with the new provider) I have only been on for 8 weeks. I have to undergo a new Esat/JCA to "make sure I'm getting the right support for my impairments". Which means I have to turn up for an Esat/JCA and speak to the same assessor that: 1) over-rode an AAT decision to downgrade my impairment points, 2) changed my DES stream to a stream that doesn't give me the supports I need to maintain employment, 3) didn't bother to assess all of my impairments and assessed an impairment (Non-FDTS) I didn't claim PS: I put Esat/JCA because they won't tell me which one it is going to be. Last time I asked for a JCA it turned out to be a Esat. The implications of whether it is a Esat or a JCA are different. I was fully aware that after 2 years I could be reviewed. But 2 months? So I asked Centrelink: You've only just done a DSP assessment, why do I need another one so soon? You made an error in changing my DES stream and refuse to correct it. You are planning to exit me from the POS you've only just put me on as when you changed my stream and thereby forcing a change of provider because you say I've been on a POS for 102 weeks but, with the new provider, it has been more like 8 weeks. They say: "Oh, well, this new JCA/Esat (no, I can't tell you which one it will be) will give us the opportunity to assess the information and correct any mistakes". I reply: So I have to go through this whole process again because you can't get your shit together and actually fix the errors, let me stay with my old provider which it is now too late to go back to and I would have to start again with them, and maybe, just maybe give me the support I need to maintain employment? Them - Well the JCA should fix that. Me - JCA? Them - or Esat. And so I wait to be exited out of the Program of Support and go through yet another JCA/Esat in the near future.

Oh no, Krystal that's shocking. Ive slowly read all of your your thread over the past months. What a trial! Are you certain that the same assessor that did your last jca will also be doing the new one? I think you can request for a particular gender assessor or maybe you could ask for someone else? Not sure if that's too easy or even its possible but I would try.

I think they've got their knives out for you, but beyond making an appointment with your MP and carting a precis of the string of affairs (bullet point a chronology without too much detail, more than a couple of pages and it wont be read), I don't know what to suggest.
Internal complaint has gotten you nowhere.
Your case is an example of gross incompetence, injustice and bullying. If you can boil it down to the bare bones and ask your MP to intervene, perhaps that might make this review disappear.
If you want to PM me your precis I would be happy to try to help you pare it down. I know from my own experience it's very difficult to do yourself when you're talking about something which has caused so much emotional distress.

Banjo I have taken your advice and have contacted her office: 1) About the situation 2) How to be a self representative at Federal Level 3) About the level of support ESS vs DMS 4) If Centrelink can override an AAT decision Four separate issues in four different contacts over the past 2 years. The only reply I have ever received is about 2) where her office staff told me to firstly contact everyone I had already contacted. When this was brought to their notice they then advised me to contact a Disability Service in NSW that deals with Disability Employment Discrimination. When this was brought to their notice I received no further communication. I have not had any reply regarding 3 or 4. Put this on top of the reply I got from Scott Ludlam's office regarding the Privacy Issue (which his office staff said he was basically a lame duck in politics) and that he couldn't help so they wouldn't give me an appointment to see him. At some time you look at the wall you've been beating your head against and claim the wall as the winner.

is it appropriate for you to indicate your c/link office? I would suggest you move. Everytime I ask, as I have on a number of occasions, Centrelink has said that the only way to change offices is to change where I live. My only hope of getting someone else is to ask for a telephone assessment. This doesn't mean that the original assessor won't be on the phone assessing me, but it may mean someone from the Queensland call centre *might* get the job.
