It's under Jenny Macklin's FaHCSIA umbrella so they are answerable to the same people. Wait and see what the result is, then look at your options then. Did you contact Welfare Rights at all? Yeah welfare rights have been a huge help, they represented me at the SSAT but the tribunal members carried on writing and seemed to ignore the WRC lady when she gave her opening submissions. Really pissed off and fed up with the whole thing.

My opinion of SSAT hearing is this.... they are mouth pieces for Centrelink and will only follow the legislation that it is applicable at the time. Also if you are having a telephone conference I believe this is taped so they can replay it and pick up on inaccuracies that you may say unintentionally but they hold as gospel. My advise.... be very careful of the curve balls that they will throw at you out of the blue. Cover your self by saying you are under medication at the moment at the moment and take your time answering them.... snore if you have to between answers just to let them know you are heavily tranquilised. That is an out for anyone should the curve ball they throw be a bomb. Good luck .......

My SSAT decision confirmed I was non resident was handed down on the 25 June. To date I have had no communication from ICL in regards to this and nothing has changed on my Centrelink site re letters, or payments changed or stopped. Anyone have any idea why... and no I don't think I will be ringing them to remind them I am non resident getting payments as normall

I think they will reassess your payments on the day you return. You will be given the opportunity to apply for NewStart and will be immediately able to apply for the DSP as well. Try not to worry about what you can do nothing about at the moment.

thanks banjo. I was thinking along the same lines but why disturb sleeping jackals with a phone call. BARAGHOPEE-... ha ha don't give them a word they can twist to the way they want.

Just an update on my situation, the SSAT upheld the decision by Centrelink to not grant me the pension and Welfare rights advised me to take it to the AAT and to also reapply for the DSP immediately.
So I reapplied and was called in for a JCA which took 10 minutes instead of the usual hour like in the past then a couple of days later I get a phone call advising me that I have been successful in my application for DSP!!
Maybe they do fear the AAT I dunno but it's weird after several applications and fighting them for bloody years they give it to me so easily on my latest application.

It's odd, and the only explanation I can think of is that if you went to the AAT and won, it would create a precedent that would allow other people to follow.

@sycksyde Is it possible that the circumstances of your disability claims might be a reason they didn't want you in the AAT, as latindancer says. Kindly send someone a Personal Message on this board please. I met Banjo and Banker from this board. I have spoken to them by PM's and Skype. And I have only been a member since April 2012. And we all put a personality to the different members the more we read their comments. Truthfully, if I worked for the department it would not take much for me to work out who I am. If that makes sense. I actually hope that someone from the Australian department of Human services reads our comments and takes note of them to help someone in the future. Whoever started this, and I'm glad I wasn't there when Banker and Banjo met each other, I thank. From what I have read on this board, we are All Individually Disabled (AID). Having said that I encourage you to share your story with someone.

My husband has a saat appointment in a few weeks ,I am really nervous for him ,would appreciate any suggestions?what is he to expect ?Also this is for portability dsp .

The AAT is accepted as the first truly independent (from Centrelink) appeal you will get, the problem being of course that it could take over a year to get there. I agree Banjo. Especially since the SSAT dont publish their decisions. Your right Rowdy: their nondisclosure wreaks of wrongdoing and hidden agendas, and we can only pray that high court judges start to confer upon rulings about the manipulation of law. Boss: So is the "AAT" the final appeals process available is it mate? I get a bit confused with all the abbreviations and order of merit I must admit, and reading legislature is harrowing because of abbreviations, but it seems the "AAT" is the end of the line for appeals: So, I wish all those looking at or undergoing appeals the very best and hopefully a huge win in your endeavours:) Be safe and stay Happy:) Ela: I wish you and your husband all the best for the SSAT dear, and I'm sure there must be one here that will be able to offer advice.
