My husband has a saat appointment in a few weeks ,I am really nervous for him ,would appreciate any suggestions?what is he to expect ?Also this is for portability dsp . So your husband has applied for the unlimited portability and been unsuccessful? How many points did he get in his main assessment? Have you spoken to Welfare Rights in your home state? They will advise you and attend the SSAT if you want them to. Their advice to me was that if you have 15 points in your main disability then you stand a chance on appeal, 10 and it's very hard. I would suggest you go to the doctor with a copy of the impairment tables and discuss it with him. hi Banjo ,he has gone through the appeal proccess unsuccesfully now has an saat hearing with 10 points for each of his disabilities ,we are just stressing out on what will become of this ,yes he has seen welfare rights so there will be someone one to help him.But just dont know what to expect??

to all fellow dspoverseas,i have a question to ask you all. say for instance that you had won an ssat appeal on residency and then a year later were in the same posItion again appealing a non resident ruling again( nothing at all has changed since the previous ssat appeal) what do you think the outcome would be at the 2nd ssat appeal?? and all they could use against you would be time out of aust which is similar to the 1st appeal?? ALL ANSWERS WELCOME!!!!

Hey Banjo you said that if your main disability is rated at 15 points you have a good chance of winning on appeal. You are talking about the UP application? On appeal you may have the point ratings needed but what about the work capacity. Are they likely to change this on appeal?

The assessor said at my interview that I had no work capacity (0-7 hours a week) in that I satisfied the requirements for the DSP. She then said that she was required to assess by eligibility for the portability solely on the impairment tables and that was when I knew I was stuffed.
When they rang me with the bad news, the first thing they said was that I had still qualified for the DSP.
I was one of those who went on the DSP back in the 90s... I nearly said last century but that would make me look nearly as old as Banker, LOL... to make the unemployment figures look better, under the present system I would have had no hope but my conditions have deteriorated since then.
I only got 10 points in my main disability and Welfare Rights told me that it would be hard to appeal on this figure, but I would have had more chance if I had got 15.
I still intended to appeal though because the legislation on this clearly states that no future work capacity is required and there's a lot more that affects people's ability to get a job that points on an impairment table. I talked to Centrelink and they said if I let it slide they would let me go on the old age pension, that was then 6 months off, 13 weeks early, for portability requirements.
It turned out to be a false promise, I won't use the word lie because the woman may not have known what she was talking about, but to cut a long story short by the time it was sorted I was only a few months off the OAP anyway, which I'm waiting out now.

I cannot see a problem, but as you well know, no one has lost the DSP on residency this year that we have heard of.
Do they think they have brought enough people back to Australia? Have they given up because of so many SSAT losses? Are they just biding their time?
It's a new learning curve mate.

to banjo,yep cheers mate!too true no one is sure as to what they are up to! prob not even them.i am back to aust this week,my 6 weeks are up and i will do another 6 weeks then i will be doing hard time in aust waiting for some medical procedures,so that will notch up my time at home this year!!

hi banjo,oley yes I have been granted dsp portability after over 3 months of stressful waiting.Ihave a question they asked me whether I wanted to leave permanetly or indefinetly,just want to know the difference and how it will affect me.Also cant get into dsp portability ...

That's great news ela.
I would assume that indefinitely means you don't know if you will return while permanently means you are sure you wont. Personally I would not use that word while talking to Centrelink, after all nothing is certain in life is it?
Not sure I understand the last sentence?
